York County Deeds Volume B-2 Pages 482-483 Roll C1483 Jos F. Wallace CC Res To Theodore M. Allen The State of South Carolina Whereas I, Joseph F. Wallace Clerk of the Court of Common Pleas for York County in said State, by virtue of the Decree and Order for sale made in the cause entitled Mary A. Wylie against Isaac A. Allen and others for the partition and sale of Real Estate of Elizabeth Wren deceased; And whereas, in obedience to said order and decree, I did, after first duly advertising the same, expire(?) the Real Estate described in the Pleadings in said cause, on Saturday in December 1879 the same being the first day of said month. And whereas the tract of land described in the pleadings in said above Entitled cause, containing Two Hundred and Eighty Two acres more or less; was bid (?) off by Theodore M. Allen of Chester County in said State, at the sum of Eight 75/100 dollars per acre, amounting to the sum of $2,472.50. Know all men by these presents, that I, Joseph F. Wallace, Clerk of the Court of Common Pleas in and for York County and State aforesaid, for and in consideration of the sum of Twenty four hundred and Seventy two 50/100 dollars to me paid and secured to be paid by Theodore M. Allen in the State aforesaid, Chester County, have granted, bargained, sold and released, and by these presents, do grant, bargain, sell and release unto the said Theodore M. Allen, all the piece, parcel or tract of land situated in York County and State aforesaid, and sold under the above titled cause to make partition amongst the heirs at law of Elizabeth Wren, deceased, situated on the waters of Neely’s Creek, adjoining the lands of Samuel Wylie, Thomas Spencer, John Ratteres (?), John D. Cornwall(?), C. D. Anderson, Jane J. Roddey, and others; And containing Two hundred and eighty two acres more or less. Together with all and singular the sights(?), members, hereditaments and appurtenances to the said premises belonging, or in anywise incident or appertaining. To have and to hold all and singular the premises before mentioned unto the said Theodore M. Allen his heirs and assigns forever. And I do hereby bind myself and heirs to defend the same as fully as I might, could or ought to warrant the same by virtue of the decree aforesaid, and in consideration of the sum of Money aforesaid. Witness my hand and seal this Sixth day of Dec’r in the year of Our Lord One thousand eight hundred and Seventy Nine, and in the One Hundred and Fourth (104) year of the Sovereignty and Independence of the United States of America.
