Benjamin Wortman (AKA Workman)of Muskingum Co., OH, provided in his will for the division of his estate as outlined in my previous posts (11/02 and 11/11/02).

As noted, his sons Samuel and William did not benefit from the sale of the property left to his widow as he had already given them land of their own. He explains this in his will. However, it appears from the following record that there was another son, Benjamin, Jr., who had also received land previously, but was not mentioned in the will.

Per SL #907,743 Muskingum CO., OH Deeds, Vol. 37-38, 1860-61:

Benjamin and Christenia Wortman had sold a piece of land to Ralph Hardesty March 28, 1828, but because of a mistake in the original paperwork all of Benjamin's heirs (both those who had previously received land and those who received shares from the sale of his estate) were required to quit claim the land over to Ralph in 1843. They accordingly signed on May 25 of that year(though the deed was not recorded until February, 1861), as follows:

"Know all men by these presents that the following named individuals who are heirs at law of the late Benjamin Wortman, Deceased, late of the County of Muskingum and State of Ohio, Jesse Wortman and Elizabeth wife of said Jesse, Jackson P. Wright and Elizabeth wife of the said Jackson, Mathias T. Ferguson and Hannah wife of the said Mathias T., Mary Wortman, Samuel B. Wortman, David Cowden and Sarah wife of the said David, Joseph Wortman and Almeida wife of the said Joseph, John Wortman and Rebecca wife of the said John, BENJAMIN WORTMAN AND MARTHA WIFE OF THE SAID BENJAMIN, Jacob Wortman and Annis wife of the said Jacob, Barnet Wortman and Eleanor wife of the said Barnet, William Wortman..."

Everyone except John and Rebecca signed. John had died; do not know what had become of his widow Rebecca.
