Hopefully I won't embarrass myself with this response, because I haven't looked a the 1812 war for a while. As I recall that war was mostly fought in the upper Chesapeake such as Baltimore with the bombardment of the fort. Last battle was in New Orleans with Andrew Jackson, Jean Lafitte etc. with a couple of ships and the men from Tennessee. I know one of my ancestors led a contingent of militia from Ashe County, NC who marched over a hundred miles to the vicinity of Monroe, NC to assist Jackson, but were told that the war was already over and they were to return home. Point is this war didn't last very long so the regiments from SC and GA probably weren't involved or needed. Having long searched from an elusive ancestor of my son's, ie, James Ratliff Whaley b. 1840, I know that there were numerous Whaley lines in Edisto Co. and at least in Abbeville in South Carolina, those folks having apparently migrated from southeastern Virginia through North Carolina. I think your guess on this Whaley being from SC is correct due to this migration pattern.
1840 SC census has at least 12 Whaleys from Marion Co., Colleton Co., Chester Co. Barnwell Co. Abbeville Co. (mostly Colleton)
1830 SC at least 8 Whaleys Charleston Co. Colleton Co. and Beaufort Co. (mostly Charleston)
1820 SC at least 10 Whaleys, Colleton, Barnwell and Charleston Counties (mostly Charleston)
1830 GA more than 20 Whaleys, mostly all different counties.
I doubt this many Whaleys all came from Virginia.
