William Weatherspoon Sr. Of Wake County North Carolina
The origins of William Weatherspoon are unclear, but I will tell you what we do know about him. According to the J.B. Witherspoon book, William Witherspoon Sr. is listed as K27 being born in 1735, but he paid Wake County Taxes in 1739. You are exempted for paying taxes when you are 60 and over. The earliest that William could be born is 1739.
There is no marriage record of WilliamWeatherspoon in Orange County, therefore I believe that he married before entering Orange County, most likely Ireland. There was a Court record in Orange County N.C. in November 1764 where “Thomas Hart vs. William Weatherspoon: Debt. This day came Edmund Fanning Esqr. And by Virtue of a Power of Attorney to him Given and Specifyed in the writing Obligatory Confessed Judgment for Four pounds Nineteen Shillings and five pence Proclamation Money to be Discharged by payment of three Pounds Eleven Shillings and five pence like Money with Costs. Judgment L3:11:6, Clerk 1:1:6.” I can not say for absolute certain that this is our William, because there was also another William Weatherspoon that was first spotted in Halifax county Virginia which was right above Orange county in 1769, but I feel that most likely this was our William Weatherspoon.
1.        139. Warrt. Issd. 411. June 30th 1778 William Weatherspoon enters 320 acres vacant land both sides of mouth of Buck Branch, a branch N East of New Hope Joining land of Thomas Pearson, including improvements where Weatherspoon now lives. The original land grant reads as follows: Joel Lane, Entry Office of Claims for Lands in the County of Wake. To the Surveyor of the said County, Greeting. You are hereby required, as soon as may be, to lay off the survey, for William Weatherspoon a Tract or Parcel of Land, containing Three Hundred and Twenty – Acres, lying the County aforesaid, on both sides of the mouth of Buck Branch a Branch of the North East of New Hope Joining the Land of Thomas Person Including the Improvement whereon he now lives. Observing the Directions of the Act of Assembly in such Case made and provided for running out Lands. Two just and fair Plans of such Survey, with a proper Certificate annexed to each, you are to transmit, with this Warrant, to the Secretary’s Office without Delay. Given under my Hand at my Office in said County the fifth day of October J. Lane.
2.        In Orange County November 20, 1778 describes land entry for William Johnston “Including an entry and survey formerly made by William Weatherspoon.” Entered November 9, 1784. Orange County Deed Book 3 p. 135, see also N.C. Patent Book 57:63 for 438 ½ acres.
3.       Warrt. Issd. #1020. February 15, 1779 Wake County Land Entries. William Weatherspoon enters two hundred acres of land in Wake County lying on both sides of Lick Branch joining his own line and Thomas Pearson’s line. 200: 50/: 5. The Original Land grant was witnessed by John Weatherspoon, Thomas Hopson, and John Humphries Jurat.
4.       Orange County Land Entries for August 12, 1779 Describes land purchased by Benj. Davis, 500 acres “includes the improvement where he lives and the improvement he purchased from Wm. Weathespoon.” Orange County, North Carolina, Land Entries 1778-1795. p. 839, also see Orange County N.C. State Land Grants pg. 755, 57:133.
5.       1780 Wake County, Court Minutes 193. A grant from the State of North Carolina to William Weatherspoon for 309 acres of land. Land no. 206 was exhibited in Open Court and Ordered to be Registred. Original Land Grant was witnessed by Henry McKoy, John Weatherspoon, with John Humphries Jurat.
6.       Wake County Court Document 1787. Ordered that James Harrington be overseer of the road in the room of Thomas Morris and that the following hands work on said road under him. William Weatherspoon and son William, David George, ohn Roberts, Reubin Hopson, John Bennet, Thomas Roberts, Benjamin Hobson, Edward Wardrope, Solomon Jones, Allen Sweats, William Hobson, Moses Roberts, Timothy Rich, George Herringdon, Isaac Smith, Zachariah Hobson.
7.       On the 1790 Wake County Census William Weatherspooon is listed with 3 males 16 and up and two males under 16 with two females. The 3 males would be William Sr., William Jr., and ?. The 2 males under 16 would be Jesse and James Hardy. The 2 females were the mother and the unidentified girl. John William, and Selah were already married.
8.       Orange County, North Carolina Deed Book 4 p. 316. Deed between Walter Alves & Amelia his wife of Orange to George Reeves of same. Includes an entry & survey formerly made by William Witherspoon. 20 Sept. 1790. See also N.C. Patent Book 57:63.
9.       Wake County Taxes, 1793 & 1794 – Captain Barbee’s District William Weatherspoon is listed with 455 acres of land and 1 free poll.
10.       1794 Court document William Weatherspoon served on a jury of James Parker vs. the exors. of Woodson Daniel dec.d.
11.       In 1796 Wake County Court Records 328-159, a bill of sale from Asa Blake to William Weatherspoon.
12.       In the September 1798 Wake County Court Minutes. William Weatherspoon and William Jr. were ordered to work on roads. John Weatherspoon as overseer. Beginning on Cedarfork from thence to Buck Branch.
13.       Deed Book O Pg. 108. 18 January 1799 Wake County Deed Book list Isaac Hunter Sr. to William Weatherspoon for 80 pounds current money a tract of 200 acres lying on both side of Sorrells Branch adjoining Nathan Almond and including the old meeting house. Witness: Nathaniel Lane, J. Rice, Bolling Hobbs
14.       The 1799 Wake County Tax list. William Weatherspoon is listed as having 505 acres with 2 WP and 2 BP.
15.       On the 1800 census for Wake County William Weatherspoon is listed with one male 45 and up, one male 16-26, one female age 45 and up, one female 10-16 and two slaves. William Weatherspoon Sr. is the one male 45 and up, the male between 16-26 in James Hardy, the female age 45 and up in the mother, one female 10-16 is the unknown sister. Both the mother and the little girl most have passed away between 1800 and 1810. There was no further record of them after this census.
16.       Feb. 1802 164-50. Court Document. Issued. Ordered that Solomon George be Overseer of the road from William Weatherspoons to County line and that the same hands that formerly worked on the said road work under him except such hands as have been directed by Order of Court to work on some other road.
17.       May 1802 Wake County Court Records 196-82. Error in the list of William Weatherspoons Taxables. Order that he be exempt from payment of three Poll.
18.       March 19, 1804 Wake County Court Document. Warrant Issued. Certificate issued. #216. William Weatherspoon entered 200 acres of Vacant land in Wake County on waters of a branch called Sorrells branch. Joining the lines of Edwin Holding, George Wardrope, James Motley and his Own lines. E. Holding, E.T.
19.       May 1804 Wake County Court Minutes. A deed from Edwin Holding to William Weatherspoon acknowledged.
20.       Feb. 1805-Jun 1805 Wake County Court Minutes, 1804-1807, Book VI. A deed from Timothy Rich to Zachariah Rich was in open court duly proven by the Oaths of Matthew Motley, William Weatherspoon and William H. Burton subscribing witnesses thereto and Ordered to be Registered.
21.       Deed Book T Pg. 255. 20 February 1806 Isaac Hunter sells a certain tract or parcel of land on the waters of Stirrup Iron Creek to William Weatherspoon, for the sum of 43 silver milled dollars. Registered in May 1806 Wake county Deed Book.
22.       Deed Book U Pg. 7. September 3, 1806 John Motley sells Cedar Fork tract of land in Wake County to William Weatherspoon for the sum of twenty pounds. Witness by Hardy Weatherspoon.
23.       October 25, 1810 Wake County Marriages. William Weatherspoon married Sarah Lowe.
24.       Deed Book V Pg. 396. November 17, 1810 Wake County Deed. William Weatherspoon buys land from Howell Ridley, James Ridley, and Willis Ridley for $337.00. The land is a tract of land situated lying and being in the County of Wake, & State aforesaid and in the Fork Stirrup Iron Creek area. Also found in Nov. 1810, Wake County, North Carolina Court Minutes, 1808-1811, Book VII (350)-160. Witness D. Jones & Thomas Taylor.
25.       Deed Book Y Pg. 420. August 30, 1814 Reuben Jackson sells 280 acres of land located on Turkey Creek to William Weatherspoon for $700.
26.       Deed Book 5 Pg. 412. January 16th 1815 a Deed between William Weatherspoon of Wake County and Benjamin Hill of Johnston County. William sold a tract of land located on the forks of Stirrup Iron Creek for the sum of $618.00.
27.       Deed Book 1 Pg. 150. February 17, 1817 William Weatherspoon sells 305 acres on the waters of North Creek to Jesse Weatherspoon 75 cents.
28.       Deed Book 2 Pg. 89. January 4, 1818 William Weatherspoon sells a tract of land to Patrick Duffee/Dupree for the sum of $450.00. The land is located of the Waters of Turkey Creek.
29.       January 5, 1818 Martha Oslin sold land in Granville County, North Carolina to William Weatherspoon of Wake County, North Carolina for the sum of $375.00, the land was on the west side of ledge of Rock Creek beginning at a Spanish Oak. Registered Feb. Court 1819.
30.       On the 1820 Granville census William Weatherspoon is listed as having 1 Male 0-10, 1 Male 45 and up, 2 females 0-10, and 1 female 26-45. Joseph is the male listed as male 0-10, William Sr. in the male listed 45 and up, Polly and Rebecca are the 2 females 0-10, and Sarah is the female listed 26-45.

To all people unto whom these presents shall come I William Weatherspoon of the State of North Carolina & County of Wake, planter for on in consideration of the love and affection which I bear unto my beloved wife Sarah Weatherspoon and for divers other good causes & consideration me request moving have given and granted and by these presents, do give & grant unto the said Sarah Weatherspoon, during her natural life a certain tract of land which I lately bought of Michael Warren towit one hundred & thirty eight acres in the county to the aforesaid lying between the waters of Haresnipe & Reedy Branch. I do also give unto my beloved wife Sarah Weatherspoon during her natural life a certain parsel of Negroes, towit Rhoda & James. Dilay Patt I do also give unto my beloved wife Sarah Weathespoon all my stock of every description also my household & Kitchen furniture also all my plantation utensils also I William Weatherspoon of the County of Wake, and State aforesaid for the love and affection which I bear to my beloved son Joseph Weatherspoon do give unto him at the death of my beloved wife the above mentioned tract of land also one rifle gun. Also at the death of my beloved wife Sarah Weatherspoon I William Weatherspoon of the County of Wake & State aforesaid for the love and affection I bear to my beloved Children towit Joseph Weatherspoon, Rebecca Weatherspoon & Polley Weatherspoon and for divers other good causes do give unto these at the death of my beloved wife Sarah Weatherspoon all the above mentioned property of every description not yet given away to be equally divided between my beloved son Joseph Weatherspoon, Rebecca Weatherspoon & Polley Weatherspoon. I William Weatherspoon will warrant and forever defend by these presents in – whereunto I set my hand and seal.

32.       Deed for William Weatherspoon of Wake County to Thomas Gooch of the County of Granville on October 26, 1825 sold for the sum of $240. The tract or parcel of land lying on the little ledge of Rocks Creek on the west side of said Creek Beginning at Spanish Oak. Registered in Open Court Feb. 1826.
33.       Deed Book 7 Pg. 17. November 2 1825 William Weatherspoon purchased 128 1/2 acres for $300.00 on Hair Snipes Creek from Michael Warren. Registered on March 27, 1826.
34.       Deed Book 7 Pg. 47. April 9, 1825, William Weatherspoon sells land to Jeremiah Morris for the sum of $40.00 on the Waters of Northeast Creek. Registered in the Registers office April 11, 1826.
35.       Wake County Court Minutes April 1837. Two Negroes, Jim and Rhoda, belonging to the legators of William Weatherspoon dec. were sold to W.W. Pratt. Jim for $827.00 and Rhoda for $362.00. May term 1839. This foregoing account of sale was returned in open court and, ordered to be recorded.
36.       On Aug 17th 1840. Rec.d of Alfred Williams Clerk of Wake County Court Three hundred & eighty five dollars & eighty two cents it being the amount paid into the Clerks Office as the distributive share of Joseph Wetherspoon arising from the sale of the Negroes belonging to the estate of William Wetherspoon dec.d. W.T. Smith Guardian to Joseph Wotherspoon.
37.       Deed Book 17 Pg. 482. September 2nd 1847 between William T. Smith Gent. For Joseph Weatherspoon of Gibson County of Tennessee of the first part and Wesley O. Smith of the second part of the County of Wake and State of North Carolina sells a parcel of land on the Hair Snipe Creek for the sum of 275 dollars. Registered in the Registers office of Wake County in Book no. 17 and page 482 the 16th day of May 1848.

William Weatherspoon Sr. most likely died shortly after the Jeremiah Morris deed of Nov. 2, 1825.
Sarah Wetherspoon married Stephen Johns on 25 April 1826. It is believed that Sarah died before 1831 because Stephen Johns remarries to Mary E. Blankenship in Campbell County Va.

The children of William Weathespoon Sr. from previous wife, which is unknown are as follows:

1. JOHN WEATHERSPOON b. between 1761 and 1765, d. 1814 in Warren County Kentucky, m. Sarah Hopson 30 Jan 1787 in Wake County. I believe that John was born most likely in Ireland, do to an article that was provided by Dortha Wren. “Wiley Witherspoon came from Ireland to America more than one hundred years ago.” Of course we know that Wiley was not born in Ireland, but his father could have. Also in the J.B. Witherspoon book M65 states that John was born in Haddingtonshire Scotland, but I have the birth records of Haddingtonshire and he was not listed there. Because of these 2 accounts this leads me to believe that John was most likely born in Ireland and then traveled to American, between 1761-4. The reason for the 1761 birth date, is because I believe that John was the witness for William Weatherspoon Sr.’s land grant back in 1779 and 1780. According to law you had to be 18 years of age to be a witness.

I give and bequeath to my wife Lucinda during her natural life or widowhood the following tract of land and all improvements to wit (description of land) also my wife Lucinda have mare, saddle, cow, 4 hogs, sheep, furniture, etc. If she marries, two beds she had when we married and all bedclothes she has made for the bed and all the money she has on hand, take with her. Remainder of my land and property be equally divided between my three children: Ewin Witherspoon, Sam J. Witherspoon, and Emily Dearing, now deceased, her share to be equally divided between her four children. The road now open and traveled to Liberty Church shall be left open if land is sold. Land given to my wife to be divided between my children at her death or marriage. Son, Samuel J. Witherspoon, Executor. Witt: W.R. Shapard and H. T. Motley.
G.       Younger Hopson b. 14 Jul 1804 in Wake County d. 18 Feb 1888 m. Martha Greathouse on 10 Oct 1825. Younger was a Baptist Preacher.
H.       Mary Ann b. 22 Jun 1805 in Wake County d. 18 March 1880 m. John Pinkney Isbell on 6 February 1827.
I.       Elizabeth b. 14 Jul 1804 in Wake County m. James Bridges in 1823.

10-304. Court documents for Wake County, North Carolina. 1790 Ssd. Ordered that John Weatherspoon be overseer of the road in the room of James Roberts and that the same hands work on said road as usual. Also Court Document 436-57.

1790 Wake County Census. Lists John Weatherspoon as having 1 Male 16-up and 1 Male 0-16 with 2 Females.

Wake County Taxes, 1793 & 1794 – Captain Barbee’s District. John Weatherspoon is listed as having 300 acres with 1 Free Polls

The 1799 Wake County Tax List. John Wetherspoon is listed as having 300 acres with 1 WP.

Dec. 1797 Court document 451-304 for Wake County. Ordered that John Weatherspoon be overseer of the road in the room of Solomon George and that the same hands work on said road as usual.

September 1798 Count document 556-389 for Wake County. Ordered that John Weatherspoon be overseer of the road beginning at the Cedarfork from thence to Buck Branch, and that the following hands work on said road under him, (to wit),
Aaron Roberts, William Thorn, James Jones, Jesse Howerton, William Weatherspoon Jur., William Weatherspoon, Herod Howerton, Lewis Hopson, and Henry Morris.

Wake County 1800 Census list John Weatherspoon with 2 Males 0-10, 1 Male 10-16, 1 Male 26-45, 1 Female 10-16 and 1 Female 26-45.

Wake County Court documents. 27th June 1805. #236. John Weatherspoon entered 100 acres of vacant land in Wake County on the waters of North East Creek.

Wake County Court Minutes February 1805. (129)-67. A deed from John Weatherspoon to James Harward proven by the Oath of Goin Barbee.

August 1805-Dec, 1805, Wake County North Carolina Court Minutes, 1804-1807, Book VI. August Term 1805 (210)-146. Issd. Ordered that Jesse Thorn be appd. Overseer of the road in the room of John Weatherspoon and that the same hands work on said road as usual.

Deed Book U Pg. 366. November, 1807 John Weatherspoon buys one hundred acres more or less lying on North East Creek from Thomas Morris for the sum of 45 pounds current money.

May 1810. Wake County, North Carolina Court Minutes, 1808-1811, Book VII (288)-98. Issd. Ordered that John Weatherspoon Jesse Weatherspoon and William H. Burton produce to this Court on Thursday next the children of Nimrod Reach that they may be better provided for.

May 1810. Wake County, North Carolina Court Minutes, 1808-1811, Book VII. Indentures from Nimrod Rich binding his Daughter Elizabeth Rich to John Weatherspoon was returned into Court & Ordered to be filed.

Warren County, Kentucky Deeds. Page 338. 3 Dec 1810 Henry Travis to John Weatherspoon, for $500.00, 120 acres on Bays Creek a branch of Big Barron River, being a part of Gills 300 acre survey, being land conveyed from William Gill to Elisha Roberts and by Roberts to John Auldridge who conveyed it to said Travis. Wit: L. Smith Scribner, James Wetherspoon.

May 1811. Wake County, North Carolina Court Minutes, 1808-1811, Book VII (410)-220. A Deed from John Weatherspoon to Lewis Herndon was duly proven by the Oath of George Brasfield Esqr.

John and Sarah moved to Warren County Kentucky about 1810. John’s Will is in Warren County, Kentucky Will Book B page 12, dated 4 July 1812, and Sarah’s will is in Will Book D page 124, recorded in July Court 1838.

John Weatherspoon’s Will.
In the name of God amen, I John Weatherspoon of the county of Warren and State of Kentucky being in perfect mind and memory do constitute this my last will and testament. I commit my Soul to God who gave it and my body to the dust from whence it –taken to be buried in a Christian like manner and my worldly goods as follows. Item I hand to my dear and loving wife Sarah Weatherspoon all my property real and personal during her life or Widowhood with the following exceptions. I give to my son James Weatherspoon one dollar. I give to my son William Weatherspoon a horse –equal in Value to a black mare that my son James now has. I give my son Major Weathespoon---before mentioned. I give my son Wiley Weatherspoon a creature of Value as aforesaid. I give to my son Younger Weatherspoon a Creature of Value as aforesaid. I give to my daughter Dorcus Weatherspoon a horse Creature of Value as aforesaid. I give my daughter Elizabeth Weatherspoon of horse Creature of Value as aforesaid. I give to my daughter Polly Weatherspoon a horse creature of Value as aforesaid each – receive their property when they marry or come of age and when my wife Sarah dies or marry then the property in her hand to be sold by the executors and all my children to be equal sharers at the time before said to receive their share. I do constitute and appoint my wife Sarah Weatherspoon my son James Weatherspoon and my brother Hardy Weatherspoon to execute this my last Will and Testament Sealed with my seal and dated this fourth day of July 1812.

The last will and Testament of John Weatherspoon, decd, was exhibited in Court and proved by (page 187). The Oat of John Beard and Hugh Hagans, two subscribing witnesses thereto, and or. And on motion of Sarah Weatherspoon and James Weatherspoon, the executors therein named, the execution thereof is granted unto them, they having taken the Oath required by law and executed bond in the penal sum of $3000, with John Beard and Hugh Hagans their securities, conditioned as the law directs.

The last Will and Testament of Sarah Weatherspoon of Warren County Kentucky.
1st It is my wish and desire that all my just debts should be paid by my executors.
2nd That it is my wish and desire to give and bequeath unto my daughter Dorcus Weatherspoon all right title and interest to the track of land whereon I now live which land I purchased of Robert Trice containing ninety-five acres be the same more or less during her natural life and at her decease the said above described land shall with all its rite title and interest shall descend to my son Younger Weatherspoon and it is – my wish and desire that my daughter Dorcas Weatherspoon and my son Younger Weatherspoon should continue to live – family and that said Younger should house - - for his sister Dorcus and provide for her all the reasonable comforts of life and it is also further my wish and desire that after all of my above named debts are paid out of said property all over and above of my – and personal estate I give and bequeath unto my daughter Dorcus Weatherspoon consisting of all my household furniture horses, cattle & sheep farming tools – and at the decease of my daughter Dorcus then to descend to my son Younger Weathersooon as above described this will – date March 31st 1838 – I assign and ordain Major Weatherspoon, Younger Weatherspoon and John Isbell my executors. C.       Ezekial preceded his mother in death.
D.       Sealey, Selah, Celia m. William Marcum on 7 Nov 1817 in Wake County
I William Marcum of the county of Wake & State of North Carolina being weak in body but of sound and perfect mind and memory or you may thus considering the uncertainty of the mortal life and being of sound and perfect mind blessed be Almighty God for the same do make and publish this as my last Will & Testament in a manner and form following that is to say first give to my beloved wife Celia Marcum the whole of my estate during her life time or widowhood then to be equally divided between the whole of my children whom I hereby appoint sole Executors of this my last will and testament and herby evoking all former will by me made in witness whereof I here unto set my hand and seal this 16th of June in the year of our Lord Eighteen hundred and thirty Three. William Weatherspoon Jr. served 84 months in the Revolutionary War as a private in the Continental line of the North Carolina militia. For his service he was given a 640 acre grant of land on Station Camp Creek in Sumner county, Tennessee. He traded this land to Mathew Kerken Dole on 5-20-1793. According to Villa Wright.

1800 Wake County Census. List William Weatherspoon Jr. as having 1 Male 0-10, 1 Male 26-45, 4 Females 0-10 and 1 Female 16-26. The one Male 0-10 was Willis, the 1 Male 26-45 was William Jr., the 4 Females 0-10 were Sealey, Rebecca, Nancy and possibly Delilah, the 1 Female was Mary.

In the name of God Amen
I William Weatherspoon Jr. of the County of Wake and the State of North Carolina being weak in body, but in sound mind and memory. As such worldly property as God has blest me with I give and dispose as follows, that is to say in the first place I devise to my beloved wife Mary Weatherspoon my plantation and Negro boy Wilson and stock of all kinds her natural life or widowhood.
I also give Willis Weatherspoon one hundred acres of land where he now lives to him and his heirs forever.
Also I give the hundred acres of land where I now live to James and Ezekiel Weatherspoon and also Wilson to be equal divided to the the said James & Ezekiel Weatherspoon to them and there heirs forever. And also I give my Girl Children my personable property to be equally divided between Nancy, Sealy, Rebecah, Delila, Frances, Bethenia Weatherspoon to them and their heirs forever this being my last will and testament. As witness my hand & seal this 31st day of August in the Year of our Lord one thousand eight hundred and seventeen.

February Term 1824 an Inventory was taken of the estate of William Weatherspoon dec.d. Jesse Weatherspoon signs as Administrator of estate. Jesse was appointed guardian over Francis and Bethany who were orphaned. On the 26th February 1829 Francis sues Jesse Weatherspoon, David Holland and Wesley Jones for her share of her inheritance.

I Robert T. Weatherspoon of the County of Wake and State of North Carolina, considering the uncertainty of life and this certainty of death and being in sound mind and memory do make this my last will and Testiment to wit:
1st I do give or lend to my beloved wife, Sarah Weatherspoon, the following property her lifetime or widowhood to wit. The entire tract of land whereon I now live ajoining the land of Needham Stone, Scott and Jenkins and others. No timber to be cut of said land except for the use of the plantation. Also one third of my interest in the Mill, Land and Stock of hogs belong to myself and Williamsons Page and everything belonging thereto. Also a choice horse and buggy and one horse wagon, two choice cattle, four choice sheep, one sow and pigs, should there be any, all the farming utensils, Three beds and all the others household and kitchen furniture that she may selects. One bible and hymn book. I also give one third of my interest in the above named Mill, Land and Stock to my daughter Caroline Barbee, and the other third to my daughter Elizabeth Dupree, also my wife Sarah's third at the expiration of her widowhood or death to be divided between my daughters Caroline Barbee and Elizabeth Dupree to have and to hold their life time and then to go to the heirs of their bodies.
I also give my son Simpson Weatherspoon my double barrel gun and apparatus. I also give Robert W. Barbee my grandson my silver watch. The balances of my property to be sold and equally divided between my wife and three children before named. It is my desire that P.H. Barbee be Executor to this my last will and testament and that he superintend the Mill for all the parties. In witness whereof I hereunto set my hand and seal this the 2nd day of April in the year of our Lord One Thousand eight Hundred and Seventy.

We the render assigners being the lawful heirs of the estate of Late Hardy Weatherspoon deceased do bargain and sell unto Jeremiah Hopson for and in consideration of the sum of two hundred and thirteen dollars one certain tract of parcel of land being a part of the Estate of said Hardy Weatherspoon. Between Jesse Weatherspoon of the first part, Josiah Barbee of the second part Robert T. Weatherspoon & Henry Williams of the Third part. Witnesses whereas the said Jesse Weatherspoon stands justly indebted to Edwin James – at Petersburg Virginia in the sum of between fourteen and fifteen hundred dollars, payable in December last, subject to a credit of one hundred & nine dollars or thereabouts with Robert T. Weatherspoon’s security also he stand in debted to the heirs of Mordecai Barbee Dec.d / towit, Melia Barbee, Patsey Barbee and Mordecai B. Deed Book 13 Pg. 1. January 12th 1838 Deed. Whereas Jesse Weatherspoon of Wake County is in debted to secure persons herein after mentioned and is honestly – to secure and pay each and all of them as far, as the whole of his property will go and he hopes and believes that the said property if sold on a reasonable credit will be sufficient to pay his creditors. The full amount if then demands total he fears that a sale thereof for cash in the present times will cause a sacrifice and so pay off no more then a part of his debts. Whereas the said Jesse Weatherspoon on the 12th January 1838 by a Deed of Trust did convey to Josiah Barbee Trusters all his property to pay a debt he owes to Edwin James – of Petersburg Va. The sum stated in said Deed, and also to secure and indemnify his sureties as Guardian of Mordica Barbees heirs which fully and at large appears on said Deed as it is Recorded in the Registers Office of Wake County on the 13th January 1838 and it is now out of the power of the said Jesse Weatherspoon to place his other creditors on a footing with them without their consent which consent they will not give – but is far as he can do it. The said Jesse has determined to have made the other Creditors on an equal footing--. Now therefore this Indenture Witnesseth thereto the said Jesse Weatherspoon in consideration of the premises and in further considerations of the Josiah Barbee, and Parchal B. Burt. Of Wake County all the lands --, goods – with notes, judgments and accounts which he owns or may be due to him. Etc….

Deed Book 13 Pg. 149. March 7th 1838 Deed. Whereas Jesse Weatherspoon executed a deed of Trust to us (Pat B. Burk & Josiah Barbee) by which he authorized the sale of his property which deed is dated the 7th day of March, 1838 and we have sold the land hereafter mentioned therefore in consideration of two hundred and thirty one dollars, to us paid we Pat b. Burk and Josiah Barbee Trusters have bargained and sold, and conveyed and by these presents do hereby bargain & sell & convey unto Josiah Weatherspoon and his heirs forever, the following tract of land in Wake County, towit, beginning at a pine, the said Jesse Weatherspoon’s line thence North to a Post Oak, in the said Josiah Barbee line thence east to a Pine, thence South to Printers thence East to a post in Beginning, Containing Two Hundred and Forty One Acres be the same more or less. To have & to hold to him the said Josiah Weatherspoon and his heirs forever in Witness our hands and seals at Wake County the 10th day of April 1838. Witness Hardy Weatherspoon, R.T. Deed book 13 Pg. 144. March 7th 1838. Deed. Whereas Jesse Weatherspoon executed a deed of Trust to us by which he authorized the Sale of his property which Deed is dated the 7th day of March and have sold the lands hereafter mentioned therefore in consideration of One Hundred and Seventy Dollars, to us paid we Pat B. Burk & Josiah Barbee Trusters have bargained and sold, and conveyed & by these presents do hereby bargain & sell and convey unto Hardy Weatherspoon and his heirs forever the following tract of land in Wake County towit, on the Waters of North East Creek, and bounders as follows. Beginning at Burtons corner post oak running north to a pine thence East to hickory thence South to a post Oak, thence West to a Pine thence North to the first station. Containing Three hundred and five acres, be the same more or less to have & to hold to him the said Hardy Weatherspoon & his heirs forever. Jesse was not located on the Wake County 1840 census, but under Smith for J. Weatherspoon lists Acres 130, Value 260, Amount .55.

In the name of God amen, I Sarah A. Atkins of the county of Orange being afflicted in body but of sound mind and memory thanks to Almighty God for the same, in and through whose mercies I hope to be saved and calling to mind the uncertainty of this life, do publish this my last will and testament manner and form following to wit. 1st after my death and all my just debts are paid and my body decently buried at the discretion of my executors hereafter named I give my sister Elizabeth Page wife of Obadiah Page Jr. during her native life and after her death to the heirs of her body, all the land that I am possessed of in the county of Orange, all that I give to my sister Elizabeth Page is given during her native life and after her death to the heirs of her body.
2nd I give to my beloved Mother Martha Hopson wife of Wm. Hopson during her lifetime and after her death to be Equally divided among all of my Sisters, all the balance of my estate both real and personal that I may die seized and possessed of, and for the settling of my estate I nominate and appoint my worthy friend William Hopson my full and sole executor of this my last will and testament in testimony whereof I the said Sarah A. Atkins have hereunto set my hand and affixed my seal the 22 day of January 1850.

According to Dortha Wren Rebecca Barbee married Lewis Hopson in Wake Co., N.C. in 1793. Rebecca was the daughter of Goin and Ann Barbee. Lewis Hopson was a son of Thomas and Sarah Hopson of Wake Co., N.C. Their children were (1) William (1796-1876), (2) Thomas Brinkley, (3) Annie Simmons Hopson, (4) Cynthia Hopson married James M. Moring, (5) Elizabeth Hopson m. John McGee, (5) Nancy m. Hiram Witherspoon. William had one son, Brinkley, and eight daughters. His second wife was Mrs. Margaret Moring Atkins.

The twenty eighth day of April in the year of our Lord one thousand eight hundred & six. I Goin Barbee of Chatham County being in health and perfect senses thanks be to God for it and calling to mind the uncertain state of this life and that all flesh must unto death when it shall pleas God to call us. Declare this my last Will and Testament in manner and form following. First being sorry for all my sins and humbly desiring forgiveness for the same I commend my soul to almighty God my Savior and redeemer in whom and by which merits I trust to be saved to have full remission and forgiveness for my sins and have and in trust in the kingdom of Heaven and my body I commit to the earth to be decently buried at the discretion of my Executor here after named and for the setting of my temporal estate and such goods chattels and debts as it hath pleased to bestow on me. I do order and dispose of the same in manner and form following that is to say First I give unto my beloved son Josiah Barbee all my Land lying in Wake County and also Twenty Five dollars in Cash to buy him a Desk. Item, I give unto my son Mordecai Barbee as good a horse Sadle and Bridle as Josiah (?) and as much stock of every kind and as much household furniture when he marries or comes of age and all the remainder of my estate after my just debts are paid. I lend unto my beloved Anne Barbee during her natural life in widowhood except the executors should think the estate was wasting but, if she marry or at her death my executor will divide my estate as underneath directed, that is to say I give unto son Mordecai Barbee the Land and plantation whereon I now live and my Desk, the balance of my estate to be divided as follows my Negroes to be valued & put in Lots and divided equally amongst all the legatees and the overplus (repeats and the overplus) to be sold & equally divided between my six children Josiah Barbee, Mordecai Barbee, Rebekah McApron, Delilah McGehee, Nancy Weatherspoon and Betsey Howard and I nominate and appoint my beloved son Josiah Barbee and John O’Kelly my full and sole Executors of this my last Will and Testament. In witness whereof I have hereunto set my hand the day and date above written.

February 1804 Wake County North Carolina Court Minutes, book VI (20)-312. Issued. Ordered that Hardy Wetherspoon be overseer of the road in the room of Micajah Sorrell and that Aaron Roberts, Ambrose Roberts, John Burgess, John Fadget, Samuel Markum, Claborn Taulton and Bridges Freeman be added to the usual hands to work on said road.

(185)-121. August Term 1805. Issd. Ordered that John Fadget be Overseer of the Road in the room of Hardy Weatherspoon and that same (sic) hands work on said Road as usual.

Aug. 1805. Wake County North Carolina Court Minutes, 1804-1807, Book VI. (191)-127. August Term 1805. A deed from Jesse Rowland to Samuel Marcum was duly proven by the oath of Hardy Weatherspoon.

February 1807 Wake County North Carolina Court Minutes, 1804-1807, Book VI. (344)-7 February Term 1807. Issd. Ordered that the following hands be added to the road of which John Fadget is overseer (towit) Gibson Maynard, Silas Maynard, Hardy Weatherspoon, Micajah Sorrell and his hands.

Deed Book V Pg. 121. April 20, 1809 Jesse Morris & Rachel Morris sells 53 acres more or less, situating lying and being on the North side of Sorrels Branch to Hardy Weatherspoon for 20 pounds. Was proven by the Oath of Dempsey Blake. Also found in May 1809-Aug 1809. Wake County, North Carolina Court Minutes, 1808-1811, Book VII. (201)-11 August Term 1809.

Hardy and family moved to Allen County, Kentucky.

To my daughters, Penelope Landers, Elizabeth Willoughby and Katherine Coleman, $100 each. To my daughter Nancy Cline, $130. To children of Simeon, deceased: Elizabeth Motley, Penelope Weatherspoon and Simeon Weatherspoon, $33 1/3 each. To Malinda Henderson, my daughter, $50, I having already given her a nag and saddle. I have given my sons, Simpson S. Weatherspoon, John Weatherspoon and N.C. Weatherspoon, $100 each, and my daughter Cyrena Davis, $100.
To my wife Martha Ann E. Weatherspoon, two work beasts, 3 cows and calf, furniture, 10 head of sheep, feather beds, etc., and I wish these at her death to go to my son Joseph H. Weatherspoon, and Mary W. Weatherspoon. The land we live on I give to my wife her lifetime, and at her death, it is to be divided between Joseph H. and Mary W. Weatherspoon. Wife, Martha Ann, Executor. Witt: H.B. Willoughby, A.J. Christy, and Jeremiah Cassaday.

William Weatherspoon Sr. m. Sarah Lowe on Oct 25, 1810. Sarah is the daughter of Stephen and Elizabeth Lowe. Children:

5. POLLY WEATHERSPOON, must have died because there is no record of her except for in the 1820 Granville, North Carolina census and the deed to Sarah Weatherspoon from William Weatherspoon dated 1824. It is believed that Polly had a son by the name of Asgil Weatherspoon. Asgil married Sarah Atkins on the 10 August 1858 in Orange County N.C., and the Bondsman was Jeffrey Hall.

On the 1850 Orange County Census Asgil was listed as Asgil Hall age 15.

Asgil Wetherspoon’s Will
Know all men by these presents that I Asgil Wetherspoon of the County of Johnston and State of North Carolina being in ill health but of sound and disposing mind and memory do make and publish this my last will and testament hereby making all former will by me at any time heretofore make.
I give devise and bequeath to Rebeccah Hall one mule that has been for some time in the care of Mr. Page Warren of Orange County N.C.
I give and bequeath to Jeffrey Hall all of my notes and claims of any kind after my just debts is paid out of them.
In testimony whereof, I, the said Asgil Wetherspoon have to this my last will and testament subscribed my name and affix & my seal this twenty eighth day of June one thousand eight hundred and sixty seven.

North Carolina Johnston County Court & Pleas & Quarter Sessions Aug Term 1867. According to Dortha Wren Asgil Wetherspoon and Joseph W. Hall who is the son of Rebecca went to Wake from Orange and both enlisted as privates on September 16, 1862. Joseph is listed as being 23 and Asgil is 27. Asgil was discharged as disabled on March 20, 1863 and Joseph was hospitalized on May 16, 1864 at Richmond Va. but sent back to his unit. Then he deserted to the enemy on August 27, 1864 and they have no further record. They were in Company E. 31st infantry Regiment North Carolina.


6. REBECCAH WEATHERSPOON m. Jeffrey Hall on September 30, 1833 and they lived in Orange County, North Carolina. These are their children according to the 1850 & 1860 Orange County Census.

Joseph was living with P.H. Mitchell, M.C. and his family.

In the 1860 census of Mt. Vernon, Joseph and Susan are listed along with their tree girls: Sarah L, Martha A., and Mary R.

In the 1870 census of Mt. Vernon, Joseph and Susan are listed along with their tree girls again and a young boy named Andrew J. Taylor, age 8 born in Illinois.

According to Nancy Manley a descendent of Joseph, she states that, “From his daughter’s obituary, it says that the Witherspoon School District in Bluford, Illinois, is named after Joseph.
