Rutherford Co., TN WEATHERLY's
I am searching for info on Mary Weatherly from Rutherford Co., TN who died, c April 1834. Her will was Witnessed by a Jane Donnel, and Mary had also witnessed Jane's son's will, Eden Donnel in 1828. I have been told that Mary was a Doak and her will mentions her "STEP-son", James M Weatherly, also a step daug, Frances.
I have found the will of Abner Weatherly who mentions the same folks and it's in Rutherford Co.,TN about 1834. (No date is on the abstract and I haven't looked up the microfilm yet?) HIS Abstract also mentions another daughter, Mary Coffy. Here is a copy of Mary's will:
"Mary Weatherly Will:
In the name of God Amen.I Mary Weatherly of the County of Rutherford and the State of Tennessee being in a less state of health but of sound mind and memory do make this my last will and testament.
I give and bequeath to my step son James M Weatherly my negro woman Ann & her child Mary.Also my silver watch, two silver table spoons and one knife and half my bed stead & furniture
2nd I give and bequeath to my step daughter Frances Weatherly one bureau and half my feather beds and stead & furniture two silver table spoons and three silver tea spoons and one half my wearing clothes.
It is my will that James M Weatherly should be my Executor to put in execution this my last will and testament.Given under my hand & seal this 19th day of April, 1835.

Mary Doak is Abner Weatherly's second wife. Mary Doak Weatherly refers to James Madison as her stepson, in her will written 19th day Apr 1835. The will of Mary Weatherly was proven in Rutherford County, TN County Court May Term 1835. Recorded Jan 12, 1836 Book 9 Pg. 203.
James Madison Weatherly born abt. 1806 married Maryann Elizabeth Batey Aug 03, 1837 Rutherford Co., TN. Daughter Nancy Weatherly born about 1808 Wilkes Co., NC married Alexander Hamilton Coffey Aug 02, 1828 Rutherford Co., TN. Daughter Frances Weatherly born March 03, 1817 Rutherford Co., TN died August 08, 1854 Rutherford Co., TN she married William Henry Haliburton Jan 31, 1838 Rutherford Co., TN.
