I am sorry to hear you have been ill, I sure hope you are doing much better now.
Now for Cabell vs Warren from what I understand the record on the law suit is in 1742 Goochland Co., Va. but for some reason NO ONE has been able to find it.I was very surprised when doing some reading that land could be taken away from someone if they did not work the land. Have you every heard of that before? This will be a good find if I ever find it.
Cabell came to VA as a Ships Doctor and decided to stay c. 1625He undertook to patent the James River Banks, some 30 miles of it, which was later taken in by Albemarle County.Circa 1735-37.
Cabell appears as a greedy fellow. . . .his idea for patenting the James R banks was obviously to control the land inland as the James R. was the only viable means for transporting tobacco down stream to the tall ships at Charles City, Jamestown, etc.
Whoever controlled the River, controlled the land and the profits there from.
Based on what scant information my intuition (theory) leads me to wonder if the Warren's operating a landing there in behalf of Nicholas Meriwether, Jr'stobacco plantations, much to the consternation of Cabell, whose idea was to force everyone to depend on his Landings to ship their tobacco.
Nicholas Meriwether, Jr held patent on almost as much land as did Cabell.Perhaps more if you add in the Lewis's land Patents.
Why was Landings on the James River so important?The reason was because when Albemarlle County formed it included a considerable amount of land SOUTH of the James River, too up until 1756-1761 when they re-aligned Albermarle County.
Further, if you noticed the map in Albermarle Roads where it showed the Platt for the Albemarle Court House one of the parcels down by the James River was held by JOHN WARREN. . . that map was circa 1745. . .
Here is what I think. . . I think the Cabell vs Warren lawsuit c. 1742 resulted in forcing the Warren's to abandon their Landing . . . . Meriwether dies c. 1744. . . . .suddenly Matthew Whittle runs out and Patents the 400 a he as been living on at least 6 yrs or more. . . . next James Wasren, SR and his wife Elizabeth sell their 200 acres each (400 acres) on the Rivanna, quickly followed by . ..
Matthew Whittle doing the same. . . . . One must assume . . .something . . .or someone must have tinkered with their COMFORT ZONE. . . . . next we find them up to their ears with Joshua Fry over at Buffalo Ridge. . . .plus after Meriwether, Jr died they no longer had his protection in the House of "Burgess or Albemarle County as before. . Thus, they sought 'cover' from that of Joshua Frye, whose connections included that of Wm. Byrd II & his childhood friend, John Chisewell, Jr.
Cabell & Co.being no match against Byrd, Chisewell, & Frye. . Interesting here is how Coffrey and Rucker did not follow the Warren's to Buffalo Ridge. . . They appear to have stayed on down nearer the James R.
After Buffalo Ridge Warren & Whittle are rarely seen until the Warren brothers die off in the 1760s.Prior thereto they quite the opossite.
Cabell vs Warren-I suspect about all one could hope to find today would be its mention in Old Goochland Ccourt Orders.In all likelyhood the actual transcriopt, if their was one, has long been destroyed.
Dr. Cabell was indeed a BIG Land Holder,but far from the largerst land holder in Albemore County.The largest was Archibald Bowling whose holdings included 5,000 acres that Present day Amherst City, VA sits on.That plus, some 40,000 acres that extended from the Twin Peaks of Otter up to Amherst City, VA.
The Bowlings were direct descendents of Pocahontas..does that explain things. . .
John Robinson sometimes, Rev. John Robinson's Mother was a Bowling, too.He is also seen prominently in Albermarle County, too.
