Lineage of Malachi Ware

IN MY OPINION, MALACHI WARE WAS THE SON OF HENRY WARE OF HANOVER PARISH, KING GEORGE CO., VA AND THE GRANDSON OF NICHOLAS WARE III - SEE WWW.WAREFAMILYHISTORY.COM

I BELIEVE HIS ANCESTORS WERE AS FOLLOWS:

1-Peter Ware Sr. (c1608 probably Cork Co., Ireland-Bet 16 Sep 1657 and 10 Sep 1659 Hampton Parish, York Co. VA). In 1647 Peter was an attorney for Robert Lewis in York Co., Virginia. In 1675, Peter Ware, Jr. sells land in Queen’s Creek, Hampton Parish, York Co., VA to Nathaniel Bacon in which he identified the land as having belonged to his father, Peter Ware. Mary Hickes was identified in a 1659 Orphan’s Court document as the widow of Peter Ware, from this document it appears Mary Hickes maintained her maiden name, which was an old Welsh custom
2-Nicholas Ware I (c1636 – Bet 1691 and 1704 K&Q Co. VA) m. Unknown. Nicholas patents 386a in 1665 with John Garrett in New Kent Co. (his brother Peter's patent in 1675 shows this land was adjacent Col. William Claiborne, Edward Cardingbrook and John Ware). According to his son Edward's 1722 patent, Nicholas I received a total of 795a from Henry Madison. Nicholas, received 415a in 1680, and an additional 380a soon after. The 380a belonged to Henry's father, John Madison, Sr., (b. c1625) of Queen's Creek, York Co., who was living adj. Col. William Taylor. John patented 1030 acres in New Kent Co. in 1664 with John Pigg, each receiving 515a, After selling his father’s land in 1675, Peter Ware, Jr., who was then living in Queen's Creek, York Co., purchased land next to his brother, in New Kent Co., VA.
--3-Nicholas Ware II (c1658->1713 K&Q Co. VA)-A 1713 patent identifies his son as Nicholas Ware, “Jr.” (III) of Stratton Major Parish, indicating Nicholas II, was still living in 1713. He was charged with 718 acres in 1704 K&Q Quit Rent Rolls.
-----4-Nicholas Ware III (c1680 New Kent Co.-1744 Caroline Co.) - a 1713 Essex Co. (later Caroline Co.) A document recently surfaced stating, "Nicholas Ware, the ancestor who lived in Stratton-Major parish had married Jenny Garrett, and they settled there in 1665, and their son went up to what is now Caroline County in as early certainly as 1713 and died in 1744 in Caroline Co. and left two sons named Henry and Nicholas." Using this new information, we would need to eliminate Nicholas Ware II from this lineage. This information is currently being investigated. A 1713 patent identified him as "Nicholas Ware, Jr." of Stratton Major Parish, King & Queen Co. (previously New Kent Co.), this 1713 patent was from Richard Long for 5 shillings, (the 5 shillings denotes a "token" sum, suggesting this may have been a close relative). This land was adjacent William Harrison, Samuel Elliott, John Buckner and John Long. A 1734 Caroline Co. court ordered him to assist with building a new road. He was to have Gabriel Long's (son of Richard who m. Margaret Harrison), John Holloway's, Nicholas Ware, Jr.'s and John Garrett's people assist, (John Garrett was later the father-in-law of two of Nicholas Ware, IV's sons). This places the birth year of the elder Nicholas, before 1693 and the younger Nicholas before 1713, but more likely 1680 and 1700, based on generations before and after. In 1727 John Buckner of Essex Co. sold him 310a near Ware's bridge, adjacent Golden Vale Swamp, John Holloway and Persimmon Branch. In 1728 he was granted 1000 acres in the fork of the Rappadan (Rapidan) River in St. George's Parish, Spotsylvania Co., VA; he sold 500 acres in 1733, and the remaining 500 acres in 1740 to Jeremiah Rawlings. A land deed shows a Jeremiah Rawlings, deceased, lived adjacent Nicholas Ware in New Kent Co. In 1741 Nicholas was appointed Constable in Caroline Co., and that same year he and John Dillard proved the will of William Harrison. In 1744 John Dillard was identified as the writer of the will of Nicholas Ware, which mentions sons Edward and Nicholas. Information, which helped to identify three sons of Nicholas Ware III, came from Pamunkey Neighbors by Sam Sparacio.

HENRY WARE OF HANOVER PARISH, KING GEORGE COUNTY, VIRGINIA

HENRY WARE (c1708-7 Oct 1750/7 Dec 1750 King George Co. VA) m. (Jane Markham ?). This may be the Henry that owned a grist mill in St. Mary’s Parish, Caroline Co. VA before 1732. Henry’s brother John was Executor for Henry’s will. Maj. Harry (aka Henry) Turner, who along with John Ware, was appointed Executor of Henry’s will refused to serve as Executor; he died a short time later. Witnesses to Henry’s will were Elizabeth Markham (widow of John Marshall) and her two sons, Benjamin and William Marshall, of Westmoreland Co., VA. John Ware, the Executor of Henry’s will return an inventory of his estate on 5 Sep 1751. Henry’s wife may have been the sister of Elizabeth Markham, one of the witnesses to Henry’s will.

Notes: Henry is first listed on the 1739 Orange Co. VA Tithe List of Constable James Pickett with 3 tithes likely living on the property that he identified in his will as the “Ware Tract.” In 1728 Edward Watts filed the original land patent for this 900 acre parcel of land, at the time located in St. George’s Parish, Spotsylvania Co., VA. On 19-20 Jul 1736, the land, then located in St. Mark’s Parish, Orange Co., VA, was leased and released from Edward Watts by Richard Mauldin of St. Margaret’s Parish, Caroline Co., VA; Richard Mauldin bought the property from Edward Watts ion 23 Feb 1743. On 25 Apr 1744 Edward and Lucy Ware, Henry’s brother, bought the property from Richard Mauldin. Prior to Henry’s death in 1750, Henry acquired the property, likely from his brother Edward via an inheritance (Edward Ware died c1747/8) or purchase. Following is a complete description of the property from the original 1728 land patent as filed by Edward Watts:

“For 900 Acres New Land in Spotsylvania Co, VA 28 Sep 1728.GEORGE the Second, TO ALL: WHEREAS, We have given granted and confirmed, and by these presents for us our heirs and successors do give, grant and confirm unto Edward Watts of Spotsylvania County one certain tract or parcel of Land containing nine-hundred acres lying and being on the branches of Black Walnut in Saint George's Parish in the county of Spotsylvania aforesaid and bounded as followeth, to wit, BEGINNING at two red oaks and a white standing in Mr. Robert Slaughter's line, thence northwest one-hundred and sixty poles to two white oaks standing on a level, THENCE west one hundred and eight-six poles to a white oak and a red standing on rolling ground in John Lee's line, thence along his line south ten degrees west one hundred and eighty-two poles to two corner white oaks and red oak saplings, corner to William Edding's and John Lee's thence along Edding's line north fifty-four degrees, west eighteen poles to a red oak bush near a ridge, thence south forty degrees east one hundred and eighty poles three corner white oaks of Edding standing on rolling ground, THENCE south five degrees, east four hundred and seventy poles to a white oak and red oak in George Purvice's line by a branch, THENCE north seven degrees east four hundred poles to a red oak and white oak corner of Watts in Slaughter's line, thence along Slaughter's line north sixty degrees, west one hundred and sixteen poles to two white oaks and a red oak on the side of a hill on the south side of branch a corner of Slaughter's thence along Slaughter's line north thirty degrees east to the beginning,” The property appears to have been located in present day Orange Co, VA on both sides of the Black Walnut Run near the towns of Rhoadesville, Bledsoe Corner, and Burr Hill.

LAST WILL AND TESTAMENT OF HENRY WARE WRITTEN 7 OCT 1750 / PROVED 7 DEC 1750 KING GEORGE COUNTY, VA

In the name of God, Amen. I Henry Ware of King George County being sick and weak of body but in perfect sense and memory calling to mind the uncertainties of life have thought it fit to make this my last will and testament in the following manner. Imprimis. I recommend my soul to God who gave it trusting in my ever Blessed Saviour to receive, pardon and remission of my sins and my body I desire may be interred in my brother’s plantation where he now lives, and for the worldly estate it hath pleased God to bless me with, I give and bequeath in manner and form following. Item I give and bequeath to my son, Markham, all my lands lying in Goochland County, to him and his heirs forever. Item I order that my land in Orange County be sold by my Executor hereafter mentioned and the money let at interest till my children come of age, and then equally divided among them. Item I will and bequeath to my wife four negroes during her life (to wit) Dick, Neaton, Betty, and James. And one fourth part of the remaining part of my personal estate. Item I give and bequeath the remaining part of my estate to my children to be equally divided among them when they come of age or marry. I appoint my friends, Major Harry Turner and my brother, John Ware, my executors to this my last will and testament. At a court held for King George County on Friday, December the seventh 1750 the last will and testament of Henry Ware, deceased, was presented into court by John Ware, one of the executors, who made oath thereto. Harry Turner the other refusing to take the executorship of him, and the same was proved by the oaths of William Marshall and Benjamin Marshall and admitted to record. Inventory of estate of Henry Ware returned to court by John Ware, his executor, and ordered to be recorded. (King George County, Virginia Order Book 2, 5 Sep 1751.

1770 - 25 Aug, In 1770 Markham, Clara, and Markham’s sisters Elizabeth & Jane, sold the 900 acre “Ware Tract” located in Orange Co. VA. Received land in Goochland from father, named in will. Indenture from the Orange County, Virginia Deed Book 15, Page 241. This indenture made the 25th day of August in the year of our Lord Christ one thousand seven hundred and seventy by and between Markham Ware and Clara, his wife, Elizabeth Ware, and Jane Ware of Culpeper County of the one part and Richard Abell of the County of Orange of the other part, Witnesseth that the said Markham Ware, Clara, his wife, Elizabeth Ware and Jane Ware for (diver ?) good causes and considerations, themselves thereunto moving but more especially for and in consideration of the sum of thirty pounds of good and lawful money of Virginia, to them the said Markham Ware, Elizabeth Ware, and Jane Ware in hand paid by him, the said Richard Abell—sold—unto the said Richard Abell all that tract or parcel of land lying and being in the county of Orange., known by the name of “Ware’s Tract”, containing 900 acres more or less and bounded as follows, that is to say, beginning at two red oaks and white oak standing in Robert Slaughter’s line ..standing in falling ground on John Lee’s line. corner to Eddins’ and John Lee’s, thence along Eddins’ line…in George Purvise’s line.. corner to Thomas Watts’ and Slaughter’s line. Signed by: Markham Ware (Seal) his wife Clara Ware (Seal) Sisters Elizabeth Ware (Seal) and Jane Ware (Seal) At a court held for Orange County on Thursday, 25 Aug 1770, this indenture from Markham Ware and Clara, his wife, and Elizabeth Ware and Jane Ware to Richard Abell was acknowledged by the said parties, the said Clara being first privately examined as the law directs.

NOTE: Henry Ware specified in his will that, "I give and bequeath to my son, MARKHAM, all my lands lying in GOOCHLAND COUNTY, to him and his heirs forever. Item I order that my land in ORANGE COUNTY be sold by my Executor hereafter mentioned and the money let at interest till MY CHILDREN COME OF AGE, and then equally divided among them. In 1770, 20 years later Markham, along with his wife Clara, and his sisters Elizabeth and Jane sell the property to Robert Abell. ADDITIONAL NOTE: Since the 1770 deed mentions Elizabeth and Jane with the surname Ware, they were still unmarried in 1770 and likely the two youngest children.

5. Elizabeth Ware b. c1743 m. FNU Hipkins/Hopkins BFR 1770. In 1770 Markham, and sisters Elizabeth and Jane, sold 900 acre “Ware Tract” located in Orange Co. VA. In 1749, Henry Ware, Elizabeth’s father, bought 170 acres of land in Tuckahoe Creek; Markham and Elizabeth Hipkins sold this property in 1764 (b. Abt. 1743). In 1770, when Markham, Elizabeth, and Jane sold the 900 acres Ware Tract in Orange Co., VA, the indenture did not give Elizabeth’s last name but did state she was from Culpeper Co. VA.
6. Malachi Ware b. c1745 age 25 in 1770, unmarried in 1770 m. Elizabeth "Betsy" Brown
7. Jane Ware b. c1747 she was unmarried in 1770 m. FNU Smith AFT 1770. In 1770 Markham Ware, and sisters Elizabeth, and Jane Ware, sold the 900 acre “Ware Tract” located in Orange Co. VA; in the indenture Jane was referred to as Jane Ware "of Culpeper Co." Jane did not participate in the 1764 land sale by Markham Ware and Elizabeth Hipkins most likely due to being underage.

Henry Ware's brother John Ware, named as his executor, for some unknown reason decided not to sell the land in 1750 and "let the money at interest until the children come of age". We can only guess as to the reason his brother's wishes were not followed. Maybe John Ware felt the land would increase in value over the years higher than it could be "let at interest" and decided to keep the property until the youngest child was 21. Maybe a value was determined by appraisal when the children reached age 21, and Markham used his money to give them their share until he decided to sell the property in 1770.

INFORMATION ON HENRY WARE'S ELDEST SON: MARKHAM WARE (c1735-Jan 1831 Gosport, IN. Buried at Liberty Hollow Church Cemetery, Gosport, IN) m, Clara Lindsay (Bet 1738 and 1754 in Orange Co. VA-Died c1818 at Clark Co. KY) d/o Joshua Lindsay and Mary “Polly” Nichols, and niece of the James Lindsay who married Sarah Daniel and Lucy, the widow of Edward Ware <1770.

INFORMATION ON HENRY WARE'S BROTHER: NICHOLAS WARE IV (c1700 Stratton Major Parish, King and Queen Co. (was New Kent Co.)-aft. 1754 St. Mary’s Parish, Caroline County, VA. In 1744 he presented his father's will in court. He appraised the estate of Thomas Powell in 1739, (possibly grandfather of Letitia Powell, spouse of his son Edward). In 1746 he was named to a Caroline Co. grand jury; in 1753, on petition of John Garrett, Thomas Buckner and Richard Buckner were appointed to view the way John Garrett petitioned a road from his house to the main road. In 1754, matters on a trespass case were referred to Nicholas Ware and John Gillison. Sons Nicholas and Henry m. daughters of John Garrett.

Note: It was recently discovered that Sarah Munday was the spouse of Nicholas Ware IV:

Below (1) shows the connnection between Sarah Munday to an unknown male Ware, in the approximate generation to be Nicholas Ware IV, who would have been involved with the Harrison, Long, Elliott, Samuel, Buckner and Smith families. We know from a 1713 Essex Co. deed, Essex was later Caroline Co., that Nicholas Ware III (c1680 New Kent Co.-1744 Caroline Co.) patented land from Richard Long for 5 shillings and this land was adjacent to William Harrison, Samuel Elliott, John Buckner and John Long. The Sarah Ware mentioned in the 1739 will of John Munday b. c1680 appears to be born c1700. Nicholas Ware, V, Edward Ware and Henry Ware, all three sons of Nicholas Ware IV, named a daughter Sarah. Elizabeth [Harrison], mentioned as the wife of John Munday in his will in (1) below, named a child "Harrison Munday," and the will of Andrew Harrison in (2) below names a daughter Elizabeth. Andrew Harrison is mentioned in (3) below with Richard Long and Samuel Elliott in a deed in 1703, connecting Andrew Harrision with the Long, Elliott, Buckner and Smith families.
(1) Will of John Munday (son of Thomas died 1703) 27 Oct 1739/18 Mar 1739/40 St, Ann's Parish, Essex Co. names sons: John, Thomas, Joseph, Charles, Harrison, a minor, and Ambrose, a minor. Daughters: Sarah Ware, Mary Ware, Margaret, Winifred, Tabitha. Wife and Executrix, Elizabeth.
(2) Will of Andrew Harrision My beloved wife Eleanor my executrix. My son Andrew and my son in law Gabriel Long as trustees. Children; William, Andrew and Elizabeth already settled on lands on which they now live; My dau Margaret Long and three youngest sons viz. Richard and Gabril and William. Wit: Jno. Ellitts, Wiliam Davison, Mary Davison, 18 Nov 1718. Children of Andrew Harrison (Dec 1648-28 Apr 1718, St.Mary's Parish, Essex Co. VA) s/o Richard Harrison who rec'd a land patent in New Kent Co., VA in 1664 and grandson of Anthony Harrison who came to VA by 1650 and Eleanor Long (b. c1650-Aft 1718) m. c1670, children:
1. Andrew Harrison, Jr. (c1686-1752) m. Elizabeth Battaile
2. William Harrison (1688-4/1742) m. Hannah Christopher (had Andrew Harrison who m. 1) UNK 2) Jane Dillard, probably the d/o John Dillard who was the writer of Nicholas Ware. Securites of the will of William Harrison were: Richard Hampton and Robert Taliafero. Proved by: Nicholas Ware and John Dillard.

(3) 24 Feb 1703/4. Surveyed for Andrew Harrison, Richard Long and Samuel Elliott, 1149 acres 80 perches on the branches of Mattapony and the branches of Puminsend Creek, corner to a patent lately granted to Harrison, Long and Elliott . . . in the fork of a branch of Mattapony and in the line of a patent formerly granted unto Mr John Buckner, deceased, Charles Smith, surveyer.

INFORMATION ON HENRY WARE'S BROTHER: EDWARD WARE (c1704-c1747/8 m. Lucy (Sanders ?). Edward’s widow Lucy m. second James Lindsay (c1700-c1782), widower of Sarah (Daniel) Lindsay (c1704-c1748) who was d/o William Daniel. This is likely the Edward who about 1740 was granted a license to keep an Ordinary, security provided by Nicholas Ware.
3 Nov 1742. Henry Elley of Hambleton Par., Prince William Co., to Edward Ware of St. George Parish, Spts. Co. 300a in St. George Par., part of the tract formerly granted Thomas Allen and George Musick, Sep 28, 1728, etc.
23 Feb 1743. Orange County, VA - Deed Richard Mauldin 900 acres purchase of Edward Watts - land on both sides of the Black Walnut Run. (Black Walnut Run is between Rhoadesville, Bledsoe Corner, and Burr Hill in present day Orange Co. VA). It is uncertain whether Edward, in his will, left this land referred to as the ““Ware Tract” to his brother Henry, or whether he sold the land to Henry.
5 Jun 1744. Edward Ware of St. George Par., Spts. Co. and Lucy his wife to Erasmus Withers Allen of St. Anne Par., Essex Co. 300a in St. George Par., Spts Co. part of pat. Granted Thomas Allen and George Musick, etc.
1748 – 13 Jan - Upon petition of Lucy Ware, it is ordered she have administration of the estate of her late husband Edward Ware, who with James Powell and Silvanus Sanders, her securities, ack. bond. It is ordered that Thomas Dudley, John Moses and George Penn appraise the estate of Edward. (Caroline County Order Book 1746-1754, Pt. II, Page 8)

INFORMATION ON HENRY WARE'S BROTHER: THOMAS WARE (c1706, he lived in Drysdale Parish Caroline Co. c1731/32). He was possibly the spouse of Mary Munday, sister to Sarah Munday who married Nicholas Ware, IV.

INFORMATION ON HENRY WARE'S BROTHER: JOHN WARE (c1710->5 Sep 1751 but < 1764) m. He was possibly married to Hannah Smith d/o Peter Smith, c1736. John was Executor for his brother Henry’s 1750 will. Owned a plantation.

INFORMATION ON HENRY WARE'S SISTER: ELIZABETH WARE (c1712) m. Edward Garrett

INFORMATION ON HENRY WARE'S BROTHER: JAMES WARE b. 11/15/1714 m. Agnes Pace of Gloucester Co. c1735, his son Nicholas b. 8/12/1739 moved to Abbeville, SC, and became known as the “Abbeville” Nicholas.

1634 -Richard Harrison pays tithes in 1634 in respect to a land patent on Queen's Creek, in Middletown (afterwards York County), in Skimino Hundred.

1647 - 24 Sep - Peter Ware, James Besouth, Philip Walker, William Coxe appraised estate of Robert Jackson, deceased. Appraisal of other property of Robert Jackson, signed by Peter Ware. (Beverly Fleet, VA. Colonial. Abstract 25, York Co. Page 37, 53) Note: James Besouth was the brother of Elizabeth Besouth who married Richard Harrison (1620-1664) of Colchester, Essex, England. James Besouth later married Joanne Jackson, widow of Robert Jackson.

1720 - Ware Long, Sr. was b. c1720, his son Ware Long b. c1750 is mentioned in Book P, page 12, 1792: Thomas Graves and wife Martha, Bromfield Parish, Culpeper County, sold to Ware Long 100 acres of land. This indenture made this 7* day of January 1793 between Ware Long of Parish Bromfield & County of Culpeper & SARAH his wife. Ware Long, Sr. named sons Christopher, Ware, Nicholas, Reuben and Gabriel. Ware Long [Jr], Henry Long, John Long, Broomfield Long and William Long are listed on the Property Tax List of Culpeper Co., VA in 1783. This indicates a daughter of Nicholas Ware, II or III married into the Long family.

On 24 Mar 1725, a Richard Corley received a grant of 257 acres of new land in Hanover County, adjoining John Harris, Mr. Garland, Elizabeth Reynolds and James Brown, on Harris' branch.

20 February 1727, Nicholas Ware of St. Mary's Parish purchases 310.5 acres near Ware's Bridge in the parish from John Buckner.

1728 - 28 Sep - Nicholas Ware was granted 1000 acres in the folk of the Rappadan River beginning at the white oak standing in the head of Maple Run in St. George's Parish, Spotsylvania Co. VA. (Virginia Patent Book 13, Page 436). (This appears to be a land speculation deal rather than a move by Nicholas to Orange Co. VA.)

On 17 September 1729, Thomas Munday of St. Ann’s Parish, planter, in love and affection of his brother James Munday of St. Ann’s Parish gave James a piece of land or wood land, “part of a tract of land given by Thomas Munday of the aforesd pish [sic] County & Colony decd Grandfather to Thomas Munday party to these presents by his last will and Testament to Thomas Munday of the pish County and Colony aforesd decd father to the aforesd Thomas Munday party to these presents relation being thereunto had may more fully and at large appear…” Signed with the marke of Thomas T Munday. 1754 Mary's will was offered for probate by Edward Ware and Millicent Powell as executors. It was proved by John Regan who swore that he saw Catherine Regan and Mourning Barksdale witness the will. Mary GIBSON died about 1754 in Caroline Co, VA. She married Thomas Jr POWELL in 1723 in VA. Court records of Essex Co, VA, state Mary was married to a John Powell before 3/25/1725.

1789 Apr 13 - This Indenture made this 13th day of April 1789: Between John Knight and Elizabeth his Wife of Louisa County of the one part & Malichi Ware of the sd County of the other part Witnesseth that the said Knight & Elizabeth his Wife for and in Consideration of the Sum of Sixty pounds Currt Money to them in hand paid before the Sealing and Delivery of these presents the receipt whereof they doth acknowledge hath Bargained Sold, & Delivered unto the said Ware his (illegible) Heirs &c one Certain tract or parcel of Land containing by estimation two Hundred Thirty Seven acres be the same more or less being in the county of Louisa and on both Sides of the South fork of Contrary River and bounded by Wm Hendrick, Robt (Jordain?) John Lane & Thomas Wingfield to have and to hold the aforesaid tract or parcel of Land with the appurtenances unto the sd Ware and his Heirs &c forever In witness whereof the sd Knight and Elizabeth his Wife hath hereunto set their hand & seals the day & year first above written. (Louisa County, VA, Wills, 3:403) William Hendrick of the County of Louisa ....I give wife Ann Hendrick Every thing that she was possessed with when I married her also the Legacy that falls to me of her Fathers Estate to my son James Hendrick the land I had of William Archeles Harris to him and his heirs forever. Item I give to my son Byrd Duke Hendrick all the land I how live on Except one Hundred Acres Lying at the lower end and on the South Side of Contrary on persission that he pays my grandson William Allen Twenty Pounds at his Arriving to the age of Twenty one years. Item I give to my Daughter Mary Hendrick one Hundred Acres of Land being the land that I mensioned lying on the South Side of the Creek at the lower End, all the rest of my Estate after paying my Debts to be Equally Divided Between all my Children To Wit William Hendrick, James Hendrick, Byrd Duke Hendrick, Mary Hendrick and Ursuly Allen. At a Court held for Louisa County May 9th 1791 This Will was this day in Open Court Exhibited by James Hendrick and Byrd Hendrick the executors therein named & was proved by the Oaths of Malachi Ware and Mourning Corley two of the Witnesses thereto and by the Court is Ordered to be Recorded the Executors having don what is usual in such Cases having Entered into & Acknowledged their Bond with approved Security Conditioned as the law directs Whereupon on their Motion a Certificate is granted them for Obtaining a Probate thereof in due form. Know all men by thee presents that we James Hendrick, Byrd Hendrick & William Garrett are held and firmly bound to Thomas Johnson Gentlmen Justice of the Court of Louisa County now Sitting in the Sum of one Thousand Pounds to the payment where well & truly to be made to the said Justice & his succefsors, we bind our selves & each of us one & each of our heirs Ecors & Admins Jointly & Severally firmly by these presents, sealed with our seals, this 9th day of May in the year of our lord one Thousand Seven Hundred & Ninety one. The Conditoin of this Obligation is such that if the above bound James & Byrd Hendrick Exors of the last Will and Testament of William Hendrick Decd de make or cause to be made, a true and perfect Inventory of all and singular the goods Chattles and Credits of thesd Decd. which have or shall come to the hands pofsefsion or Knowledge of thesd James & Byrd Hendrick or into the hands & pofsefsion of any another person or persons for the same so made, to Exhibit into the County ourt of Louisa at such time as they shall be thereunto Required by thesd Court and the same goods Chattels and all other the goods Chattles & Credits of thesd Decd. which at any time after shall come to the hands psfsefsion or knowledge of thesd James & Byrd Hendrick or into the hands and pofsefsion of any other person or persons for them to well and truly administer according to law & further to make a first & true Account of their Actings & Doings therein when thereunto required by thesd Court & also shall well and truly pay & Deliver all the Legaciecs Contained & Specifyed in thesd Testament as far as thesd Good and Chattles and Credits Will thereunto Ectend and the law shall Charge them this Obligation to be void and of None Effect or Else to remain in full force and Virtue.
