Martha Pettipool vs. Benjamin Wade (Halifax Co., VA)
I could use some help from Wade researchers and experts...
The following rather cryptic records from Halifax County, VA, Plea Book 1:
[21 Mar 1753]“Martha Pettipool vs Benjamin Wade, deft. By Thomas Nash here atty. Granted an imparlance, plt. by Clement Read his atty. granted the same.”
[20 Jun 1753]“In case of Martha Pettipool vs Benjamin Wade, deft. by his atty. does not answer, judgment to be entered against him unless he answer plt.’s complaint at next court.”
[19 Sep 1753]“In case of Martha Pettipool vs Benjamin Wade by their attnys., a jury, to wit: John Bates, Richard Brown, James Daniel, John Binum, John Hix, John Laws, Anthony Griffin, Daniel Green, Daniel Smith, Henry Prewet, Samuel Harris and Robert Moore, find for the plt. £3/2/6 and costs, by reason of nonperformance.”
MIGHT suggest a relationship, and something of a family feud over an inheritance between Martha Pettipool (wife of Seth Pettipool) and Benjamin Wade.It should be noted that it is somewhat unusual that a married woman (Martha) should sue someone (Benjamin Wade) in her own name and behalf.There are many who have claimed that Martha was a Ragsdale, but I don't think this is the case.Was she possibily a Wade?
Could Martha and Benjamin have possibly been siblings?Was this case possibly over an inheritance that Martha thought she had coming, and that Benjamin (possibly the executor) did not deliver to her?
Anyone have an alternate explanation for this case?(Ralph Griffin, Charles Smith, Drury Smith, and Seth Pettipool were witnesses for Martha in the case; Peter Overbee, Robert Wiles, and Richard Griffin were witnesses for Benjamin in the case - if that helps.)
