Will Written 21 January 1767
In the Name of God Amen I Spencer Ball of Northumberland County Gent. Being sick and weak but thanks to God of useful (? ) mind and memory do make Public and declare this writing to be as my Last Will and Testament , Revoking all others by me made heretofore ; And first as to what estate in Lands I am now possessed of I dispose as flows to wit ,
I give to my eldest son Spencer Mottram all the Lands and appurtenances I hold to below the Hill bounding by the meadows thereof from the line of The Hon'ble Presley Thornton Esq. To my gate & running from thence down the said small branch ( so as to leave the s'd water stream to my s'd son ) to the line of Monrow ; including the quantity of eleven hundred and fifty acres or thereabouts to him my s'd son Spencer Mottram , and to heirs male of his body lawfully begotten forever, and in default of such issue I give the same with the appurtenances to my son James and to the heirs male of his body lawfully begotten , upon his paying to the daughters of my s'd son Spencer Mottram one thousand pounds curr't money and in default of such issue I give the said lands & appurtenances to my son Jesse & unto the heirs male of his body , and in default of such issue I give the same to my son William & to the heirs male of his body lawfully begotten forever. I also give to my said son Spencer Mottram the lands and appurtenances which was settled on me by an Act of Assembly in Lieu of the Lowerys tract to him and his heirs forever.
I give to my son William the lands and appurtenances that I purchased of Col. James Ball for him on which he now lives together with all the slaves, stocks of cattle & other personal chattels that he is now possessed of to him and his heirs forever. I also give to my s'd son William the mare called Wagstay and her black filly, twelve head of sheep & four cattle to him his heirs and assigns forever.
I give to my son James the lands and appurtenances that formerly belonged to my brother William to be divided from the lands given my son Spencer Mottram according to the discretions in the s'd devises also all the lands and appurtenances that I purchased of Peter Spencer Hack, Benjamin Knight, and Maj. William Tates to him my said son James and to the male heirs of his body lawfully begotten and in default of such issue I give the s'd lands and appurtenances whereon my brother William lived as above described to my son Spencer Mottram and to his heirs forever & the other lands and appurtenances divided as above to my said son James I give to my son Jesse and to the heirs male of his body forever.
I give to my son Jesse the upper part of my lands called Black Point containing four hundred acres , to him & to the heirs male of his body lawfully begotten & in default of such issue I give the same with the appurtenances to my son William and to his heirs male of his body forever .
I give to my son Spencer Mottram my mill with the appurtenances , to him & his heirs forever and I desire that my s'd son causes to be ground in the same, all his brothers William and Jesse's grain ----- ------
I give to my son Spencer Mottram the following slaves , to wit, Old Winny, Yellow Tom, Long Nan & her child, Hannah, Nell, Williamson, Little Charles, Luke, Robin, Lemon, Kate, James, Giles, Letty, ----- Joe, Sarah Mina , Rhody, Patt, Mafey, Moll, Jane, Andrew, Tim, Old Rachel, Short Nan, Little Will, Black Daniel, Great ---- , Great Jim, Old Moll, Great Moses, Silve, ------- & Williamson to him and his heirs forever.
I give to my son James the following slaves to wit , Abel, Mills, Sillah, Charles, Great Tom, Fillis, --------, Mose, Great Will, Winny, Chloe, Soloman, Hannah, Rose and Rachaels, child Adam, to him and his heirs forever .
Item. I give unto my son -------------------------------------------------------------------------------------------equally amongst his children & to their heirs & assigns forever the following slaves to wit , Aaron & Betty ( which are now in my s'd sons Spencer Mottrams possession and Jambo ; one I----n that my s'd son Wm be allowed to keep them and receive the benefit of their labour without any moderation whatsoever.
I give and devise to my two grand sons Spencer and John Jones of John Cralle, the following slaves to wit , Liddy, Hannah, Isaac, Agatha, Lucy & Mott together with all the increase of the s'd slaves. ( being the negros by me lent to my daughter Judith Cralle in her lifetime ) to be equally divided between them , to them & to their heirs forever. I also give them the two small colts that was last ---- by my chesnut sorrel & Baul faced mares and I desire that my friends the Hon'bl Presley Thornton Esq. And my son in law William Roane to be guardian my s'd grandsons , and that they be educated & maintained from the profits of their estate.
I give to my grandson Spencer Ball one negro boy call'd Emanuel to him & his heirs forever
I give to my grandson Thomas Roane one negro boy call'd Michael to him & his heirs forever
I give to my grandson Spencer Roane one negro call'd York to him & his heirs forever
I give to my grandson James Harman two negros call'd Rachael & Isaac to him & his heirs forever
I give to my son in law Will'm Roane the negro girl Peggy w'th he is now in possession of to him & to his heirs forever and also one hundred pounds curr't money over and above what he has already received of me as his wifes portion.
I give to my son in law Winder Kenner the negro Daniel in lieu of fifty pounds cash and also four hundred and fifty pounds curr't money as his wifes portion , I also give him the baul face mare & a chestnut sorrel mare.
I give to my son Spencer Mottram my three ------ to wit , Polly , her daughter & granddaughter & the young ---- ------- ---- half my stock of hogs, all the rest of my cattle & sheep after my three other sons have rec'd their parts & my deer in the park together with half of all my household & kitchen furniture ( including the new goods sent for & design'd for that purpose ) and I desire that my s'd son receive in his part of the furniture , the clock and tables in his possession at this time.
I give to my son James , the old sorrel mare , two year old filly , forty head of cattle, forty head of sheep ( including those now on the plantation where my son William lives) one fourth part of all my stock of hoggs household and kitchen furniture ( including the new goods sent for & designed for furniture) and I desire my son James receive in his part , the clock in my dwelling house to him & his assigns forever.
I give to my son Jesse , the old sorrel mare , two young sorrel mares , two black chair ------- , one skew bould colt , thirty head of cattle, thirty sheep, my riding chair & harness , one fourth part of my stock of hoggs household & kitchen furniture ( including the new goods sent for & designed for furniture ) to him & his heirs & assigns forever.
I give to my wife , my two bay ---- horses & my riding top chair
Item my will and desire is that my wife have her dower and full part that the law entitles her to in my whole estate , assigned to and allotted her out of the lands and negros & other estate by me given & bequeathed to my two sons James and Jesse without any manner of encumbrance on my other estate and if my said wife should contrary to this my will, claim any of my other estate , so as to burden it , on account of dower as aforesaid , then my will and desire is and I do give and devise all the lands , slaves & personal estate before me given to my two sons James and Jesse ; to my sons Spencer Mottram and William to be equally divided between them to them their heirs & assigns forever.
Item all the rest and residue of my estate , both real & personal , I give to my son Spencer Mottram and to his heirs and assigns , he paying my debts . And lastly I constitute my s'd son Spencer Mottram my whole and sole executor. In testimony whereof I have hereunto set my hand & seale this 2- nd day of January Anno Dom. 1767.
Sealed , Published & declared by the Testator as & for his Last Will & Testament in presense of us

This Last Will and Testament of Spencer Ball Gent. Was produced in Court by Spencer Mottram Ball the executor therein named who made oath thereto according to law and being proved by the oaths of Andrew Robertson, William Greenwood, and James Wilkins witnesses thereto , was admitted to record and on the motion of the said Exor giving security . Certificate is granted him for obtaining a Probate thereof in due form.
