Wm Mortimer SMITH shot/killed by Wm. Philips in K&Q Co in 1866

William Mortimer SMITH was born 1839 in King and Queen county, Virginia. He participated in the Civil War - fighting on the Confederate side - and returned home to his young wife, Mary Sutherland MOTLEY, after the war ended in 1865.

On 4 September 1866, he was shot - and killed - by William PHILIPS, while he was on his own front porch. Story goes that Wm. Philips served only about 8 years in prison for the murder.

Does anyone know what prompted the shooting ... or why Mr. Philips got such a light prison sentence?
