You have proven that Thomas Upchurch born 1846 was the second husband of Martha Wheeler through court papers you posted. Plus the census records point to this conclusion.
Thomas B. Upchurch the son of Thomas Upchurch b. 1806 and Rhoda Anderson Upchurch lived in this HH until at least 1880 as a single man. Thomas Upchurch born 1846 the son of Gilliam and Eliza Murray Upchurch was married to Martha Malone @1865 and is listed on the 1870, and 1880 census with Martha and family.

Is seems that Thomas lived with Martha Malone for over 25 plus years and raised his family. Then Martha must have died and he got involved with Martha Wheeler and had to marry her reluctantly. It is obvious that he did not take care of her or their son Barry.( did you not say that Barry changed his surname to Wheeler?) I did not know that Thomas married a second time until your post.

This same Thomas Upchurch age 66 listed as father in law is on the 1910 census Jackson Co. District 7 page 79B living with his daughter Eliza Upchurch Carter and her husband James Carter and family. The same Eliza and J.M.C. Carter that give depositions in the Murder case.

The common link to all of this is Gilliam Upchurch, jr Grandson of Gilliam, Brother to murder victim Tom Upchurch, age 30, and son of Thomas and Martha Malone Upchurch. Stepson to Martha Wheeler. His testimony can be found in both murder transcript and action against him by Martha Wheeler Upchurch in the property dispute.

I don't know where Thomas Upchurch born 1846 was in 1900. Hiding out, I suspect from his second wife.
