Estate of Dulcebella Crawford, Dec’d Final Record The State of Texas, Washington County Probate Court Middle Term 1861 ( blank ) of said County, the undersigned would respectfully represent that Dulcebella Crawford late of said County departed this life Feb. 3rd, 1861 leaving a last will and testament in which the undersigned are named as Executors of the same. They therefore ask that said will be admitted to Probate at the next term of your Court, and that letters of Executorship may be granted to them as the law directs, and they will ever pray. Bishop and John Alexander will apply for letters of Executorship upon the Estate of Dulcebella Crawford Deceased at the next term of the honorable the county court for said county to be held at the Court House in the Town of Brenham on the First Monday in March next AD 1861. This is therefore, to notify all persons interested in said application to appear and contest the same if they see proper to do so. Attest S. S. I Dulcebella Crawford of Washington County, being of sound and disposing mind and memory do make ordain, and publish this, my last Will and Testament, and first, to my beloved Grand daughter Alice Blake, I give and bequeath my Negro Boy Lem. It is also my will and desire that my said grand daughter Alice Blake shall be subject to no charges for any expense of board attendance to her stock or clothing for herself as any other expense which I may have incurred on her account while she has lived with me, Second, It is my will and desire that all of my other property of whatever kind, notes, debts etc. shall be sold and the proceeds of the same equally divided between my three daughters, Gabrella, wife of B. P. Duncan, Eliza, wife of A. W. Kirk, and Sarah Ann, wife of James M. Woodward all of said County after the payment of my Just Debts. Third, It is my wish will and desire that one quarter of an acre of land now used as a grave yard be reserved for that purpose, it being the same lying near the present residence, and it is also my will that sufficient means for walling in a family burying ground on the said quarter of an acre be reserved out of my Estate before final decision as directed in clause second. Fourth, I nominate and appoint James D. Bishop as testamentary guardian of my said Grand Daughter Alice. Fifth, I nominate and appoint James D. Bishop and John Alexander as Executors of this my last Will and Testament. Cale, who upon oath, says that he by the request of Dulcebella Crawford, Deceased, witnessed her making & signing her last will and testament, and bearing the date Jan’y 30th 1861. J. E. Application to Probate Will March 7th 1861. At this term of the Court came on to the heard the application of James D. Bishop and John Alexander to Probate the last will and testament of Dulcebella Crawford Dec’d where upon came into the court J. E. Cale and on of the Subscribing witnesses to said last will and testament and proved the Execution of same in due form of law, and it appearing to the Court that the proper notice had been given, It is therefore ordered and decreed by the court that said last will and testament of the said Dulcebella Crawford Dec’d be admitted to probate, and that the same together with the proof thereof be Recorded. Know all men by these presents that we John Alexander as principal and ( ) as sureties are held and firmly bound unto the Chief Justice of the County of Washington, in the sum of six thousand dollars for the payment of which well and truly to be made unto the said Chief Justice we bind ourselves and heirs, Executors and Admistrators jointly and severally firmly by these presents. As witnesses our hands this 19th day of March AD 1861. The condition of this obligation is such that whereas the above bound John Alexander has been appointed executor of the last Will and Testament of Dulcebella Crawford, Dec’d now if the said John Alexander shall well and truly perform all the duties required of him under said appointment then this obligation shall be null and void, otherwise remain in full force and effect. Hosen Clerk WC Estate of Dulcebella Crawford Dec’d In County Court April 1st 1861 Executor Bond Filed March 23rd 1861 At this term of the court came on to be heard the bond of John Alexander with W. A. Dallas and John McKnight as securities in the sum of six thousand dollars as Executors of the last Will and testament of Dulcebella Crawford, Dec’d. It is ordered by the Court that the same be and is hereby approved and ordered to be recorded. Estate of Dulcebella Crawford Dec’d In County Court April 2nd 1861 Application to Appoint Appraisers. At this term in court came on to be heard the application Ordered by the court that A. E. Hunt, Dulaney McNesse and J. C. Harris be and they are hereby appointed to Inventory and appraise all the property belonging to said Estate, and make return to this present Term of the Court. Inventory and Appraisement of the Estate of Dulcebella Crawford Dec’d as made by John Alexander Executor with the assistance of A. E. Hunt, Dulany McNeese and J. C. Harris appraisers to wit: One Negro Boy named Lem $800 One Negro Boy named George $600 40 Bushels of Corn $70 600 lbs of Bacon $90 4 head horses $150 40 Hogs $120 One Two Horse Waggon $40 One Yoke of Oxen $35 Household & Kitchen furniture $8 One plow & hoes $3 $1,916 All the above is the separate property of the said D. Harris who being duly sworn say that the valuation of the property as above made is a full and true appraisement of the same as specified in the above inventory of the Estate of Dulcebella Crawford Dec’d. In addition to the inventory of the Estate of Dulcebella Crawford fled April 2nd 1861, John Alexander Executor with this assistance of Dulany McNeese and A. E. Hunt two of the appraisers appointed by the court returns the following tract of land under the following circumstances and submit the same to the Judgment of the Court to determine the interests of said Estate and other parties in an to the same to wit: 100 acres of land conveyed to the legal heirs and representatives of James M. Crawford former husband of the said D. Crawford Dec’d situate and lying on the waters of the Yegua River in said County being the two leagues grant made by the State of Coahuala & Texas to James F. Perry and wife & valued at $1,500.00 The State of Texas, Washington County Personally appeared in open court Delany McNeese and A. E. Hunt two of the appraisers appointed by this court to appraise the property of Dulcebella Crawford Dec’d, and being sworn say that the valuation of the one hundred acres of land hereto appended is a just and true appraisement of the land according to the best of our judgment and ability. Turner Chief Justice The State of Texas Washington County Personally appeared in open Court John Alexander, Executor of the Estate of Dulcebella Crawford Dec’d and being duly sworn says that the original Inventory amounting to $1,916.00 and the additional inventory of the 100 acres of land appraised at $1,500.00 and the list of claims hereto attached is a full and complete Inventory and list of the property and claims of his testator, the said Dulcebella Crawford Dec’d that has come to his knowledge. Hosen Clerk WC Estate of Dulcebella Crawford Dec’d Inventory Filed April 2nd 1861 In County Court April 2nd AD 1861 At this term of the court came on to be heard the Inventory of the property belonging to the Estate of Dulcebella Crawford Dec’d the same being examined and fully understood by the court. It is therefore ordered and decreed that said Inventory amounting to the sum of $1,916.00 be and the same is hereby approved and ordered to be recorded. Estate of Dulcebella Crawford Dec’d Additional Inventory Filed April 4th 1861 In County Court April 5th 1861 At this term of the court came on to be examined the additional Inventory to the property belonging to said Estate, the matters and things in said Inventory being fully understood, It is therefore ordered and decreed by the Court that the additional Inventory of the property belonging to said Estate be and the same is hereby approved and ordered to be recorded. The State of Texas Washington County To the Hon. Chief Justice of the said County, the petition of B. P. Duncan and Gabrella his wife, A. W. Kirk, and Eliza, his wife, and James M. Woodward, and Sarah Ann his wife, represents that your petitioners and one Alice Blake, a minor, all the legal heirs and representatives of Dulcebella Crawford, late of said county and that John Alexander, Esq. is the Executor of the last Will and Testament of said decedent; that said decedent owned and possessed certain lands, negroes , and personal property and devised, bequeathed and disposed of said property by said Will, that said testatrix bequeathed to Alice Blake a certain negro boy Lem, and to your petitioners the residence of her said estate. They pray your honor for an order authorizing and directing said property belonging to said estate, except said negro Boy Lem, and a certain tract of land described in the Inventory of the property filed by the executor and to distribute the proceeds of said property as provided by the said Will. They further show that a certain tract of land fully described in a deed from James. F. and Emily M. Perry to the heirs of James M. Crawford which is herewith filed, was owned and possessed by said testatrix in community with her late husband, James M. Crawford, that your petitioners are entitled to the entire interest of their said Mother, the said Dulcebella Crawford of said tract of land, under and by her said Will, and that your petitioners are entitled to each a one fourth equal interest of the community right of their said father, the said James M. Crawford, in said land and that said Alice Blake, minor child of Blake and grand daughter of said testatrix is entitled to the other fourth interest of the community right of the said James M. Crawford. They pray for an order and commission for the partition of said tract of land among said heirs and legatees according to their said interest and right therein and petitioner prays (as well). Hosen Clerk CW Estate of Dulcebella Crawford Dec’d Application for partition In County Court April 5th 1861 Be it remembered that at this term of the court came on to be considered the application of the legatees of Dulcebella Crawford Dec’d for the sale of a negro boy George and certain personal property and the matters therein being fully understood and it appearing to the court that said testatrix by her Will directed her property after certain bequests, to be sold and the proceeds to be equally divided between said legatees and no one objecting to said application, It is considered by the court that the executor of said Estate proceed on Saturday, the 11th day of May next at the late residence of the said deceased between the hours of 10:00 AM and 4:00 PM, to sell on a Credit Till the 1st day of January next, with 1 % interest per annum with good security the following described property to wit: 40 bushels of Corn, 600 lbs of Bacon, 4 head of horses, 40 head of Hogs, one two horse wagon, one yoke of oxen, and plow and hoes, and also all the household and kitchen furniture of said Dec’d, and it is further considered by the Court that said executor expose at public sale at the court house door in the town of Brenham on Tuesday, the 7th day of May next between the hours 10 AM and 4 PM to the highest bidder on a credit until the 1st day of January next, reserving interest in the purchase money at 1% per annum, the negro boy George and shall secure the purchase money by two good securities. It is further considered that said executor shall reserve out of the proceeds of the sale of said property an amount which with the cash in his hands, and the debts due to the estate shall be sufficient to pay the expenses of the administration, the debts, and liability of the Estate and to comply with the provision in the third clause of said will and that he shall divided and distribute the entire residue of said proceeds equally among said legatees, that is to say to Gabrella wife of B. P. Duncan on equal third, to Eliza, wife of A. W. Kirk an equal third, and Sarah Ann, wife of James M. Woodward, one equal third and it is further considered that the following tracts of land described more fully in the deed from James F. Perry and his wife to James M. Crawford dec’d shall be divided and partitioned among the heirs and legatees as follows to wit: To Gabrella, wife of B. P. Duncan 7/24 seven twenty fourths. To Eliza, wife of A. W. Kirk, seven twenty fourths 7/24. To Sarah Ann, wife of James M. Woodward, seven twenty fourths 7/24. and to Alice Blake the remaining three twenty fourths (3/24) and it is further considered that D. W. McNeese, Edwin McNeese, and W.F. Jarrell be and they are hereby appointed commissioners to divide and partition the said land among said heirs and legatees in accordance with the above directions equally and Lastly, in case that the land cannot be divided equitably among the parties, the commissioners shall report the fact to this court at the present term. Jarrell you were at this present April term of the County Court of said County to partition certain lands amongst the legatees of the estate of Dulcebella Crawford Dec’d a copy of which accompanies this writ. You are therefore authorized to make said partition and distribution as set forth in the order of said court and make due return to this present term of the Court of law you executed the same. Court, would respectfully report that in their opinion said tract of land will not admit of an equitable division among the distributes, we therefore make special report and appraise the land improvements and such at valuation of Twelve Hundred Dollars. Commissioners to partition certain lands belonging to the estate of Dulcebella Crawford Dec’d the matters and things in said report being fully understood by the court. It is therefore ordered by the court that the report be received and is hereby approved. The State of Texas County of Washington Know all men by these presents that we A. W. Kirk, James M. Woodward, and B. P. Duncan of said county am held and firmly bound unto E. D. Turner, Chief Justice of said county in the sum of one thousand dollars which payment well and truly to be made we bind ourselves our heirs and assigns firmly jointly and severally firmly by these presents the condition of the above obligation is such that whereas the above bound persons on behalf of their respective wives who are heirs and legatees under the will of Dulcebella Crawford dec’d have applied for a sale and partition and distribution of the estate of said deceased in the County Court of said county. Now if the above bound persons shall well and truly pay all the just debts against said estate not paid that have or may be allowed by the executor and approved by the court, then this obligation to be void and of no effect, otherwise to remain in full force and effect. Kirk et als Filed May 4th 1861 In County Court May 6th, 1861 At this term of the court came to be heard the bond of A. W. Kirk, James M. Woodward, and B. P. Duncan for the sum of $1,000.00. It is ordered by the court that said bond be and the same is hereby approved and ordered to be recorded. Return of Sale of the property belonging to the estate of Dulcebella Crawford Dec’d made in obedience to an order of the probate court made at its April Term 1861, after due and legal notice of the same the one hundred acre tract of land embraced in said order of sale and described in the original Inventory of said estate was on the first Tuesday being the ?? of May 1861 at the County Court House door of the County of Washington within the hours prescribed by law, put up at public outcry at which sale J.M. Woodward & B.P. Duncan being the best and highest bidder became the purchasers of said tract of land at the sum of $15.05 per acre $1,505.00 The Negro boy George also included in said order was also sold at the same time and place at public outcry A. W. Kirk being the purchaser for the sum of $910.00 An the 11th of May 1861, after legal notice the personal property of said estate was sold To John Hunt 1 yearling colt $25.25 “ 2 year old filly $65.50 “ Lot of Hogs $151.50 To B. Lockridge 1 old mare $27.25 To Wm. Short 1 3year old horse $53.25 To James Woodward 1 yoke oxen $45.00 $367.75 All on a credit till the first of Jan’y 1862 taking note with approved security. State of Texas Washington County Before me S. S. Hosen Clerk of Co. Court of said county: personally appeared John Alexander who being sworn says that the foregoing is a just and correct return of the sale of the estate of Dulcebella Crawford Dec’d made in obedience to an order of the probate court at its April Term 1861 John Alexander Esq. It is therefore ordered by the court that the same be and hereby approved and recorded. Kirk and Eliza Kirk dated March 4, 1859 due one day after date and bearing ten percent interest . . . $300.00 2 One note made by R. B. and W. I.
