Probate records

Perhaps some one can answer my question. In 1891, if a person lived in one county in TX and was killed, had a short district trial, sent his remains to his residence in the same county and later his body was moved to another county for burial. Would probate be in the county where he was killed or in the county where he was buried? Thanks.
