"An Illustrated History of Grayson County, Texas", by Landrum & Smith has information on those in Grayson Co, TX by the time of the 1860 census. The following info appears to have come from the 1860 census:

James(sic) Davis, b Tenn c 1825 -- m Sarah b Tex c 1825 -- Ch: Thomas F. b Tex c 1852, John b Tex c 1854, Breason(sic) L. b Tex c 1857, Miller b Tex c 1859.

If Harvey was a judge, there should be something on him there locally. Have you tried the Red River Historical Museum, 301 S. Walnut, Sherman, TX? Or, the Sherman Public Library, they have a nice genealogy collection, and might have something on the Davis family.
Happy Hunting.
