Dallas Morning News Dallas, Texas February 16, 1886 Sherman’s Budget of News Sherman, Feb. 15: . A Nation Case Some time since FRANK TUCKER of Burlington, Montague County, became involved in a difficulty which ended in Tucker killing his man. He was arrested and placed under bond for his appearance before the criminal district court of Montague County. In order to secure good legal talent to defend his cause, he gave a note for the prompt settlement of attorney’s fees incurred in the trial. This he did and upon final trial was acquitted of the charge of murder. He, however, did not pay his attorney’s fees at the promised time and suit was brought upon his note, which was well endorsed. About the time of the suit, the cattle belonging to Tucker were driven into the Nation, and as he had no property in Texas subject to attachment, his sureties, had the judgment to face. Some time afterward Tucker’s cattle were found on this side of the river and were attached by officers of Montague County. Tucker at once went before U. S. authorities and swore out a complaint against CHARLES COOK, GEORGE TUCKER, and others, charging them with theft of his cattle and driving them into Texas so they could be attached. Cook and Tucker were arrested at Burlington late Saturday night by deputy marshal JOHNSON and are now on trial in Sherman on the charge preferred by FRANK TUCKER, who is not present..the court found the facts substantiated did not justify further detention of the defendants and ordered their immediate release.
