Will of Rachel Townes [née Stokes] – SC Archives Online STATE OF SOUTH CAROLINA GREENVILLE DISTRICT I Rachel Townes being of sound mind and disposing memory do make this to be my last will and testament. Item 1st For the purpose of paying and satisfying all the debts and claims of every king that my son John H.[A] Townes may have against my estate at the time of my death. I will and devise to him the following property as sufficient for that purpose viz I devise to my said son John H. [A] Townes the Johnson tract of land containing one hundred and fifty acres of land more or less and one half the Paris tract of land also the following negroes Reuben a negro man and a negro woman Hannah and her two youngest children Sarah Ann and Mary but if he shall be unwilling to accept the same my will is that all said property land and negroes be sold and the procedes applied to the payment of any just claims he may have to establish and the surplus equally divided amongst my children. Item 2 I will and devise to my son John A. Townes all my interest in the Colcock [added by hand crossing through Mance?] tract of land and all my interest in one third of the home tract of land the latter to him during his life and after his death to William Augustus [correctly spelled here] Townes and should the latter die without leaving male issue alive at his death then said home tract of land to go to the youngest son of G. F. Townes and it is my will that John A. Townes shall have the privilege of residing on the home place as long as he may live. I also will and devise to my son John A. Townes a tract of land known as the Lynn Watson tract to him and his heirs forever. But as a condition of my son John A. Townes receiving and enjoying the lands devised to him he is required to W. Augustus Townes all his interest or claim in the other two thirds of the home tract and to G. F. Townes all his interest and claim in the Brushy Creek tract absolutely and forever. Item 3 I further will and bequeath to my son John A. Townes a negro man Bratcher shall belong to and be taken care of by John A. Townes and W. A. Townes. Item 4 I will and devise to my son W. Augustus Townes the River tract of land containing five hundred acres more or less to him and his End of page 1 heirs forever. I also will and devise to W. Agustus Townes all my interest in the other two thirds of the home tract of land but he is to remain and enjoy these devises of land on condition that he shall release to John A. Townes all his interest in the Colcock tract of land and to G. F. Townes all his interest in the Brushy Creek tract of land. Item 5th I will and bequeath to my son W. Agustus Townes to negro men Ben and Manuel and a negro child Bill son of Hannah also Rose and her child and furtue [sic] increase to him and his heirs forever. Item 6th I will and devise to my son G. F. Townes all my interest in the Brushy creek tract of land also I will and bequeath to G. F. Townes a negro boy Rial son of Annis. But as a condition of receiving and enjoying the said devise his [he] is required to releast to John A. Townes and W. A. Townes respectively his interest in the Colcock tract and home tract of land according to the provisions of this will to each of them interest in the Colcock land to J. A. Townes & the home tract to J. A. Townes one third and to W. A. Townes two thirds. Item 8th I will to my executors a negro woman Annis in trust for my daughter E. P. Blasingame [Eliza Paul] with power on their part to sell or exchange her for other property with like trust the legal title to remain in the hands of my executors and the procedes of the hire or interest of said property to be paid to my said daughter annually during her life and after her death to the children of my son Samuel A. Townes. Item 9 I will to my executors a negro woman Sylva and her children and future increase also a negro man Stephens in trust for the separate use and benefit of the family of my son Samuel A. Townes (his wife and children) and my executors are to have the power to sell or exchange said property and make other investments of said trust property but is my desire that the negro man Stephens shall never be carried out of this district. Item 10 My executors are directed to select a good horse or mare from among my stock of cattle and horses and hogs and the and give the same to my grandson Samuel Townes all the rest of my stock of cattle and horses and hogs and the growing crop I will and devise to my sons John A. Townes and W. Agustus Townes and but out of this End page 2 they are required to pay all lawful debts I may be woint [?] at my death. I also will and devise to them on the same terms and conditions my waggons [sic] and farming tools and the set of Blacksmith tools. Item 11 All my household and furniture I devise to be divided equally between all my children as they may see fit or as any two disinterested persons chosen by my executors may determine. But the house hold furniture and other articles now in possession of my son S. A. Townes I leave to my executors in trust for the separate [sic] use of his family. Item 12 All debts or demands which I may have or hold against any of my children I will to be cancelled and released by my executors at my death no payments being required. Lastly I do hereby revoke and annul all former wills made by me and declare this to be my last will and testament and I do hereby appoint my sons G. F. Townes John A. Townes and W. Agustus Townes executors of this my last will and testament my executors are directed to raise out of the crop which may be left at my death the sum of twenty five dollars to be appropriated to aid in rebuilding Salem Meeting house. And I further request and require my sons John A. Townes and W. A. Townes to pay the sum of twenty five dollars annually for the support of my Brother Jonathan [Stokes?] and his wife accoring to the terms of a writing drawn up by G. F.
