Lucy Fitzgerald Will and Milton G. Kelso Family

I am still looking for information on the Milton G. Kelso family of Columbia County, Arkansas and their ties to my Alexander John FRIARSON/FRIERSON family of Columbia County, Arkansas.

I am also posting the WILL OF LUCY FITZGERALD.

WILL OF LUCY FITZGERALD

Columbia County, Arkansas

In the name of God Amen I Lucy FITZGERALD of the County of Columbia and State of Arkansas being in not very good bodily health but of Sound and disposing mind and memory calling to mind the frailty and uncertainty of human Life and being desirous of setting my worldly affairs and directing how the Estate with which it has pleased God to bless me shall be disposed of after my decease while I have Strength and capacity to do so, I make and publish this my last will and testament hereby revoking and making null and void all other Last wills and Testaments by me heretofore made And first I command my immortal being to him who gave it. And my body to the Earth to be buried in a decent and Respectable Manner by my Executor herein after named And as to my worldly Estate and all the property Real and personal of which I shall be seized and possessed or to which I shall be Entitled at the time of my decease, I devise bequeath and dispose them of in the manner following to wit: My will is that all my just debts and funeral charges shall by my Executor herein after named be paid out of my Estate as soon after my decease as shall by them be found convenient.

1st Item: I give devise and bequeath to my beloved Grand Daughter MARY JANE KELSO and two of my beloved Grand Sons Milton Kelso and Henry Clay Kelso one note of hand on Martin F. Fletcher for five hundred & three Dollars done on the first day of January 1854 also my Negro woman named Harriette and her increase and her child a Boy named Jim about two years old also the North East Quarter of Section thirty two Township Eight Range one west also the South West Quarter of Section Thirty Two in the Same Range and Township also the North West Quarter of Section six Township seven Range Two west in the State Mississippi & County of Lafayett.

Item 2: I give and bequeath unto my Beloved Daughter ELIZA J JONES five Dollars in cash to be pay by my said Executor when called on by Said Eliza J. Jones.

Item 3: I give and bequeath to my beloved Grand Daughter Martha Angeline Kelso all of my Estate Remaining in the State of Virginia to be collected by my Said Executor and paid over to said Martha Angeline Kelso after deducting out all expences of Collecting the same. The property bequeathed herein to my Grand Children Mary Jane, John Milton and Henry Clay Kelso to be Equally divided.
I do nominate and appoint Milton G. Kelso to be the Executor of this my Last will and testament in testimony whereof I the said Lucy Fitzgerald have to this my Last will and testament I have here subscribed my name and affixed my seal this Seventh day of January in the year of our Lord one thousand Eight hundred and fifty six.

On this day personally came and appeared in open Court Robert Atkinson and William H. Murphy two of the Subscribing witnesses to the above and foregoing Last Will and Testament of Lucy Fitzgerald and after being duly qualified for that purpose deposeth and saith that they saw Lucy Fitzgerald assign the same at her request by R. Atkinson in their presence and in the presence of the other Subscribing witnesses and that she declared that it was her Last will and testament in their presence and called upon them to Subscribe the same as witnesses and that they Subscribed their names as such witnesses in her presence and in the presence of each other and that she was of Sound and disposing mind at the time of Subscribing the same

Probate within & for the aforesaid County of Columbia do herby Certify that the above and foregoing last will and testament of Lucy Fitzgerald was filed in my office for Record on the 19th day of July D 1856 and duly recorded in Book A for wills ?? on pages 33-34 and 35

In Testimony whereof I hereunto Set my hand and affix my probate seal there being no seal of office this the 26 day of July AD 1856
