On 23 September 1789, Robert wrote his will, naming his wife Elizabeth as sole beneficiary, naming Samuel Brockman as executor, and having as witnesses John Tisdale, George Morris, Salley Morris [his wife, nee Biggers], Elijah Thomson and John Maddison.
"In the name of God Amen I Robert Thomson of the County of Louisa and parish of Trinity being of sound mind & Memory at this time thanks be to Almighty God for the same, but being sensible of the decay of Nature and the certainty of death, in order to dispose of my temporal Estate after my decease according to my present desire have thought Expedient to make my last will and testament in Manner following:Imprimis I commend my spirit unto the hands of my Blessed Saviour Jesus Christ, after my just Debts Being paid:I give & bequeath as followeth:ItemI give unto Beloved wife Elizabeth Thomson all my Estate both real and personal to her and her heirs forever; lastly I nominate constitute and appoint my beloved and trusty friend Samuel Brockman my hole [sic-whole?] & sole Ex'r of this my last will and Testament hereby Evoking [sic-revoking] all other will or wills by me heretofore made, and declaring this to be my will & testament in witness whereof I have hereunto set my hand & seal this twenty third day of Septem'r 1789."
Estate Administration:On October 12, 1789, Samuel Brockman posted bond (with Robert Wasley and William Linney as co-sureties) as executor[the Court Clerk erroneously recorded this as "Samuel Brockman Executor of the last will and Testament of John Thomson deceased" and then also erroneously concluded the bond with the date October 12, 1790].On October 14, 1789, William Thomson, George Morris and John Madderson inventoried the Robert Thomson estate and submitted the Inventory of Appraisement to the Court on November 9, 1789.On October 25, 1789, Brockman held an estate sale.The sale items included various woodworking tools (chisel, gouge, square, auger, "plains" and "sundry tools").Does this suggest Robert might have been a carpenter, a cooper, or a cabinetmaker (as well as a farmer)?The estate also includedsix beds or bedsteads, suggesting a large family (I believe children did not each have her/his own "twin" bed in those days but doubled or tripled up.)This would be consistent with the 1782 report of a household of 11 persons.Alternatively, six beds could also be consistent with Robert being some type of furniture maker.Among those buying from the Estate were William and Samuel McGehee, and an Augustine McGehee, who married Sarah (Wyatt) Thomson, widow of Mathew, about this time.
I have not yet found (perhaps one does not exist?) any record of guardianship proceedings on any minor children of Robert Thomson in Louisa County in 1789-90 (i.e., no mention in "Where Have All the Children Gone" by Rosalie Edith Davis).Does this suggest that Elizabeth moved her family out of Louisa before the end of 1789?Or is guardianship only for (a) total orphans (i.e., both parents dead) and (b) for stepfathers?
On 14 October 1799, Robert's estate was "settled".It showed that, in 1789, the Estate received money from Thomas Gardner on a bond (and a John Gardner had purchased an item at the Estate sale) and from William Poindexter on a bond.The Estate had also received cash from "Humphress" in 1797.In 1793, the Estate received the "balance" of the John Thomson bond.There was a 1789 (?) payment of 15 pounds (a sizable percentage of the total Estate) to Thomas Gardner "for moving Elizabeth Thomson" and a 1787 (sic-- 1789???) expense "for copies [of court records?] to send to Elizabeth Thomson".There was a 1789 payment (of 10 pounds) "By Richers (?) Judgment", a payment to James Hendrick "pr. Court", and two payments (totaling over 5 pounds) to Robert Wasley "for Rob't Shelton's order for Prosser & Trents".In the Court records, following the accounting is the following:"In obedience to an order of Louisa Court to us directed we have proceeded to settle the accts of Sam'l Brockman exect of Robert Thomson De'd and find the s'd Brockman has satisfactory vouchers for all the debits on s'd acct and there appears to be due the s'd Brockman the sum of twelve pounds agreeable to the within after allowing him four pounds for his services given.Wm Thomson, Rob't Wasley"
