Hello Eleanor. Let me get right into this. I have a book called "Descendants of William Spencer of Montgomery Co. N.C."
Anyway in this book on page 388 it says this:
Judge Samuel Spencer died in 1793 as a result of a bizarre accident in which he was pecked by a tukey, and suffered a fatal infection. (Fayetteville Gazette, April 30, 1793).
Whith this much background, let us turn to Joseph Spencer of Burke Co. who seems to have had a relative - probably a sister - named Hanna Spencer. The tale starts in January 1783, when as the guardian of Hannah Spencer, "daughter of Rebekah Watkins, now the wife of Joel Blackwell". (Rutherford Co. Court Minutes, January session, 1783). And right away we are into a baffling puzzle. was rebekah watkins the widow or divorced wife of a Spencer (Judge Samuel Spencer). Who had later married Joel Blackwell? At least we know something about Joel Blackwell. He was Baptist minister, and a private in the Revolutionary War, who resided in the Green's Creek section of what is now Polk Co. (formed out of Henderson and Rutherford in 1847). He was member of, and probably a preacher at, the Baptist Church of Green River, one of the constituent Churches of the Broad river Association organized in 1800. he continued as an active member, and represented the group until 1839, when he died. (Anyway lets get back to HannaH)
Our first record associating Joseph Spencer with Hannah Spencer is a complaint filed in the Sept. session of the Burke Co. court in 1787. In peculiar for, it started out: "John Doe" by his attorney Waightstill Avery complains of Richard Roe". The suit was evidently intended to try title to certain land, but why the "John Doe" for was used is not clear to the writer. In any event, the complaint recited that on 10 May 1787, in Burke Co., Joseph and Hannah Spencer had demised to the said John Doe 300 acres of land "being lately heretofore in Tryon Co., now in Burke Co., on both side of Crooked Creek a branch of the Cataba River including the mouth of Camp Branch". The Complaint went on to allege that the demise was for a 10-year term, but that on the same 10th of May 1787 Richard Roe had forcibly entered the land and ejected John Doe, damaging the plaintiff in the amout of 250 pounds (before dollars), (Records of Superior Court for Morgan District, DSCR 205.408.1.)
How did Hannah and Joseph come to own this land jointly? It sounds as though they had inherited or been given the property, but when we don't Jumping ahead in time for the moment, we find what may be an echo of the forgoing law suit in an agreement dated 15, Oct. 1804, Between Col. David Vance of Buncombe Co. of the one part, and Samuel Chunn (of Buncombe co.) and Joseph Spencer (of Burke Co.) for long time dependanded a Suit in the Superior Court of Law for Joseph and Hannah Spencer Against John Potillo heirs and James Forgey and the said David Vance is interested therein as far as one half the costs of the suit (the half Forgy would have paid if Chunn agreed to dismiss the suit "and forwever quit Claim to the lands Contained in said Forgys Claim Supposed to be about 15 to 20 acres. (Buncombe Co. Deed Book A, p, 446)

Well Eleanor I'm sure this story is as clear as mud to you as it was to me but anyway it does talk about Hannah Spencer. There is much more, It goes on to say that Hannah aparently married this Samuel Chunn It also say in the 1800 Census for Buncombe that listed is Samuel Chunn age 24-45 with a female 16-26, assuming this is Hannah it would make her being born in or after 1774and before Jan. 1783when she became Judge Sameil Spencers ward.
Anyway I hope this helps. again the Book is Descendants of William Spencer of Montgomery Co. N.C. I got from the Spencer Genealogical society. You might look them up and check it out.
