Henry's will, 1765, Culpeper Co., VA; proved 1770.
I am not related to this family, just entering information to be helpful.I have a copy of a page from a book "Wills from Land Office Records):
p. 158 "Henry Sparks, Culpeper County, Mar. 1765 - In perfect health.To my two godsons Benjamin & George Petty all my land to be equally divided, but Benjamin Petty to have his coice of sd landNeither Benka or George to disturb their mother Martha Petty from living quietly on sd land during her life single, but after her decease or marriage said benja & George to possess & enjoy.In case either of my Godsons die without heir land to Susanna Petty a dau. of Martha Petty.In case Susanna Petty should die without issue, the land to the three sons of John Layton namely John Layton, Junr, Thomas Layton, & Stephen Layton to be equally divided between the three brothers, but Stephen to have first choice.To Susanna Petty one feather bed & furniture, one cow & calf, two ewes.To Martha Petty her choce of my feather beds & furniture thereto belonging.The remainder of my estate to be equally divided between Martha Petty, Benja Petty, George Petty & Susanna etty.Exec:Martha Petty, Thomas Layton, Benjamin Petty.(Signed) Henry (X) Sparks.Wit: Aaron Bledsoe, Reuben Powell, Mumford Stevens.Proved 19 Apr. 1770.Inserted after Reuben Powell's name "is dead."From order to enter for probate, Bledsoe & Stevens swore they sawReuben Powell, decd, sign as witness to sd will.Roger Dixon, Clk."
