I have a copy of the estate for William Smitherman Sr. It is in the Bibb County Orphans Court Minutes 1818-1825. Here is a small portion of the estate, the first gives a complete list of the heirs of William Smitherman Sr. [excluding his sons Joseph b. 1794 and Jesse b. 1790 who were the administrators of his estate] and the second lists where his son Samuel was not a resident of the State of Alabama.
When you look at the list of heirs of William Smitherman Sr. then go to his son Jesse Smitherman b. 1790's esate you see that they are the same heirs. Jesse and wife Phereby did not have any children so his estate had to be equally divided between his next of kin which was his siblings and their heirs. By the time Jesse died the only children of William Smitherman Sr. that were still living was: Elizabeth Smitherman Tucker b. 1784 wife of Benjamin Tucker, the youngest son Andrew Smitherman b. 1800, and Massina "Sinah" Smitherman Jones b. 1802 who was the next to youngest child.
In the distribution of his estate ["Bibb County Orphans Court Minutes 1818-1825 page 69] it has heirs listed as such: Catherine Latham late Catherine Smitherman, Samuel Smitherman, William Smitherman, Edward Lawrence in right of Sarah his wife late Sarah Smitherman, Benjamin Tucker to Elizabeth his wife late Elizabeth Smitherman, Lawrence Latham to Polly his wife late Polly Smitherman, Margaret Smitherman, Andrew Smitherman, Massina Smitherman & Rebecca Smitherman children of the intestate.

WEDNESDAY October 23rd 1822.
"This day came William Smitherman, Andrew Smitherman, Lawrence Latham and Benjamin Tucker next of kin of William Latham late of Bibb County deceased and fully before the Judge of Bibb County Court relinquished to Joseph Smitherman and Jesse Smitherman any rights or pretense of rights which they may have to administer on the
estate of WILLIAM SMITHERMAN deceased and therefore Joseph Smitherman made oath that the widow and relick of the said William Smitherman is also deceased and hath departed this life before the decease of the said William and oath being also made by the said Joseph Smitherman that SAMUEL SMITHERMAN eldest son of the said William Smitherman is not a citizen or which forth of this State.
William Smtiherman Sr's eldest son Samuel Smitherman did not come to Bibb County, Alabama. He remained in North Carolina where he died about 1836.
