Gavin Scott (died 1826) of Catcraig & Gowanglen, Orchard, Carluke

I am trying to trace the origins of the family of R & W. Scott Preserve Makers, Carluke. Clues arise from GAVIN SCOTT and his Disposition, Will and Inventory - which are listed below.

This Gavin Scott (who died at Gowanglen in Nov 1826) was said to be the 'brother or uncle' of the Robert Scott who married Agnes Lindsay in 1789. This Robert Scott was the grandfather of Robert and William - founders of R. & W. Scott Preserve Makers, Carluke.

Gavin Scott married Catherine Smith in November 1768 in Carluke.

Together they made the following Mutual Disposition. I wonder where HOLLANDGREEN is?

Does anybody recognise any of the names?

Testament of Gavin Scott, tenant of Catcraig and Catherine Smith his spouse.

In order to demonstrate their love and affection for one another, dispone and assign in favour of the longest liver, the whole of their heritable and moveable estate.Then on death of the longest liver the subjects to be equally divided amongst the nearest heirs of us as detailed as follows:

We nominate and appoint, Robert Scott, weaver in Hollandgreen, to be sole executor, legator and intromitter with the whole lot. After the death of the longest liver of us, Robert Scott is to give up the inventory, and then to:

Pay debts and Funeral expenses
To pay legacies to different persons aftersaid, as follows:

1. to the said Robert Scott £50 Sterling
2. to Elizabeth Russell, residing at Catcraig, £50 Sterling. The said Elizabeth Russell shall have the liberty to retain all the bed and body clothes that I, the said Catherine Smith may be deposed to give her during my lifetime - the other heirs shall have no claim thereto.
3. to Catherine Weir, daughter to Andrew Weir, indweller in Lanark, the sum of £5 Sterling.
4. to Gavin Scott, son of the said Robert Scott, £5 Sterling.

Which four sums are to be paid out the first and readiest of said subjects over and above their proportions and whatever remainder is to be equally divided betwixt the said Robert Scott and Elizabeth Russell (and their heirs and assignees)

and to Jean Scott, relict of William Russell, late of Dublin
and to Mary Scott, spouse of John Torrance, in Waygateshaw Townhead
and Elizabeth Scott, relict of John Allan, late in Kilbride
and Thomas Smith in Abbey Green
and the heirs of William Smith, late in Cambusnethan
and the heirs of Janet Smith, late spouse of John Brown in Lanark
and to Margaret Smith, spouse to John Wardrop in Woodhall

That although sundry of heirs have larger families than others it is hereby declared that they are only entitled to draw the share that belonged to their parents if deceased.

Divide at Whit and Martinmas after the decease of the longest liver.

INVENTORY of GAVIN SCOTT
At Glasgow Sheriff Court
8th March 1827

At Glasgow the eighth day of March Eighteen hundred and twenty seven years compeared Stephen Gray, Writer in Lanark.

INVENTORY of the personal Estate and effects of Gavin Scott sometime tenant in Catecraig and late in Gowan Glen who died on the sixteenth day of November 1826, with interest due on the principal sums at that date:

1. Sum in bill drawn by the deceased upon and accepted by Alexander Morton in Braidwood dated February 1811 = £40. Interest due thereon from 29th May to 16th November 1826 = £2
2. Sum in bill drawn by the deceased upon and accepted by Thomas Steel Esqr of Waygatewshaw, dated 29th May 1824 = £100. Interest due thereon from 29th May to 16th November 1826 = £1.17s.5d
3. Sum in Bill by Andrew Weir residing in Lanark dated 1st October 1820 = £19.10s. Interest due thereon from April 1st till the said 16th November = £5.10s.3d.
4. Sum in bill drawn by the deceased upon and accepted by Alexander Rodger in Hollbar and Elizabeth Russell his spouse, dated 1st August 1819 = £21.12s. Interest due thereon from 1st August 1819 till 16th November 1826 = £7.19s.4d.
5. Sum in bill drawn by the deceased upon and accepted by Robert Lockhart in Carluke dated 7th August 1825 = £5. Interest due thereon from 7th August till 16th November 1826 = 1s.6d.
6. Sum contained in Letter of Obligation granted to the deceased by James Gilchrist of Gillfoot, dated 6th November 1824 = £60
7. Sum in bill drawn by the deceased upon and accepted by John Wardrope at Woodhall and Margaret Smith his wife = £49. Interest thereon believed to be for seven years = £17.
8. Sum given in loan by the deceased to John Torrance at Waygateshaw head for which there is no voucher = £4.
9. Sum deposited by the deceased in the hands of Robert Scott in Gowan Glen = £33.12s.
10. Value of the deceased bed and body cloths = £2.

TOTAL = £369.2s.6d.

At Lanark the sixth day of March 1827 years in the presence of Stephen Gray, Writer in Lanark Commissioner named by his Lordship the Commissary of Lanarkshire, compeared ROBERT SCOTT, residing in Gowan Glen in the parish of Carluke, Executor nominated by the deceased Gavin Scott sometime farmer in Catcraig (? Gatecraig or ?Latcraig) afterwards residing in Gowan Glen, who produced Commission to the said Stephen Gray fortaking his oath to the verity of the foregoing Inventory which Commission the said Stephen Gray having accepted and the said Robert Scott being solemnly sworn and examined depones that the said Gavin Scott died upon the sixteenth day of November last and the Deponent has entered upon the possession and management of the deceased's personal estate as Executor nominated by him and Catherine Smith his wife upon the 20th day of June 1811 and Registered in the Sheriff Court Books of Lanarkshire, at Hamilton the 22nd day of July 1823, an Extract of which is now exhibited and signed by the Deponent and the Commissioner as relative hereto that the deponent does not know of any settlement or writing, relative to disposal of the deceased's personal estate and effects, or any part of them, other than that now exhibited: That the said Inventory which is signed by the Deponent and Commissioner as relative hereto, is a full and true Inventory of all the personal and moveable estate of the said deceased Gavin Scott, wherever situated, already recovered or known to be existing, belonging or due to him beneficially at his death, and that the said Estate is of the value of £300 Stg and under the value of £450 Stg all which is the truth as the deponent shall answer to God.
