On the basis of the Marriage & Death Records, it would appear to be the first of those two Census entries.

I have tried to locate Elizabeth Hunter or Law; but none have come up with certainty in the 1841 Census.

There is a likely Death for his mother, Elizabeth Hunter or Law, 1903, Peebleshire, Newlands, suggesting his mother out-lived him by about one year.

You should VIEW the Scanned Image of this Death Record, to find out the Informant, usually a (grown-up) child of the Deceased.
