Benajah Saxon; Mary Brown; Halifax Co NC

By his will dated 1773 in Brunswick Co VA, Richard Brown named 11 children. One of them was Mary "Sexton" as appears by the abstract that I have seen. I think that it is pretty well accepted that it should have been Saxon.

I see where various accounts say that Mary Brown was married to Samuel Saxon who died 1766 in Halifax Co NC.

However, I wish to disagree, since Mary Brown and her sister Susannah Brown witnessed a deed wherein their father Richard Brown bought some land in Halifax Co in 1763.

By my accounting of Richard Brown's children, his daughter Mary was born about 1747-1749.

In 1762, Richard Brown was still in Brunswick, but he moved to Halifax after buying some land there. Richard Brown apparently lived in Halifax for at least 6 or 7 years before moving back to Brunswick. His son John Brown was in the Halifax area back in 1761 when he was given a bequest of 600 acres of land by Archelaus Saxon.
(doesn't anybody wonder about that generous bequest?)

(footnote:I estimate (conservatively) that Richard Brown was about 50- 52 years old when he purchased this land in Sep 1762, and that he was only about 60-63 years old when he died in 1773.)

One year later, Richard Brown bought another parcel from the same people. The deed #2 below seems to show that as of Oct 1763, his daughter Mary Brown was an unmarried daughter. Thus, her marriage to a Saxon occured after 1763.

The 2 deeds below as found at :

Mary Brown did marry a Saxon, but I can't figure out which one. I'm thinking that it was the youngest son John Saxon. It appears that he might have been born about 1747-1749 same as Mary Brown.

Mary Brown had a son named Benejah Saxon who was born about 1769. He married 4 Feb 1790 in Brunswick Co VA to Martha (Patsy)Abernathy, daughter of James Abernathy. I figure that he was 21, but perhaps he was a bit younger.

He died in Brunswick Co in 1815 and a Richmond Dugger administered his estate.

His 1810 census in Brunswick Co VA is fairly hard to read, but it looks like he and his wife were both under age 45, and they had 2 children between the ages of 10-15 in the household. The girl apparently was 10 years old and her name was Temperance. She got married in 1821 in Brunswick Co to William Phipps.

In 1795, Beneger Saxon and his wife Martha sold his inherited land that was down in Halifax Co NC. His mother signed away her dower interest at the same time by her inclusion in the deed. About one month later, Benejah Saxon's mother married for the 4th time. She was about 48 years old in 1795.

deed #3

25 May 1795 - Mary Clark and Benejah Saxon of Brunswick Co., VA, sell land In Halifax Co., NC to James Wallace. Halifax Co. NC, DB 19, p. 245, 6 Jan 1798: “James Wallace of Halifax Co. to Peter Morgan of same. $275. 200 acres which sd James Wallace purchased from Benijah Saxon & his wife Martha & Mary Clark of Brunswick Co., VA, 25 May 1795, joining Hynes, Perkins, William Daniels. Wit: Alexander Horn, Thomas Marks, H. Motley. Feb Ct 1804.” [11]

I might add here that I think William Daniels was married to Sarah Brown, another daughter of Richard Brown, but I haven't really looked hard at this line yet. Thomas Marks was married to Martha Brown, a first cousin of Benejah Saxon.
