James Sale, Son of Cornelius Sale, possibly solved

This all starts with the publication of the Nicholas Smith family history in the William and Mary Quarterly in July 1897. In that history it states that Ruth Smith married FNU Fisher and had Ann Fisher. It also states the FNU Smith married a Sale. In fact, Ruth Smith married both.

Ruth Smith was the second wife of Benjamin Fisher. Benjamin married first, Margaret Sale, daughter of Cornelius Sale of Essex County, Virginia. She had two daughters, Mary and Elizabeth Fisher, and then died between 1733-1735. Benjamin then married Ruth Smith circa 1736. She and Benjamin had a daughter, Ann Fisher. Then Benjamin died in 1744.

Ruth then married James Sale, probably around 1745, but definately before 16 November 1755, when Nicholas Smith wrote his will identifying her as Ruth Sale. James and Ruth apparently were living in Caroline County and have children James and Mary Sale. James dies while a young man in 1775 and leaves a will which mentions sister Ann Goode, who I say was Ann Fisher, who married Timothy Goode. He also mentions sister, Mary, and a brother, Samuel. He names his uncle, William Dunn as executor.

Why is William Dunn his uncle? Because William Dunn married Lucy Smith, sister of Ruth Smith. This comes via the Nicholas Smith family history.

Who is brother, Samuel? He could be an unamed son of James and Ruth; or he could be the son of James and a first wife, possibly Esther Samuell. Esther is alleged to have married a Sale. More work needs to be done on this relationship.

James apparently died before 1765 because Ruth Sale is plaintiff in a lawsuit in Caroline County for that year. James may have died in 1752. A James and Mary Sale are made wards to William Sale and Giles Samuel in that year.

Ruth Smith must have died circa 1771, because Samuel is named guardian of Mary Sale in that year. Then in 1774, William Dunn is named guardian of Mary. In that guardianship Mary is identified as the daughter of James Sale.
