Joseph RUTLEDGE was of Prince Edward Co., Virginia. Joseph assumed to be born in Virginia possibly Amelia Co or Henrico Co. Joseph married Mary/Polly said to have been a PASCHAL. I think Mary’s surname to be in error. See following comments for Mary below. These land records show that Joseph listed in Abbeville, South Carolina census for 1800 to be another Joseph – possibly his son or another Joseph altogether. Next record I have copies for is Joseph’s probate. He died late 1813 or early (before February)1814 in Greenville, South Carolina. An Inventory and Appraisment is ordered by the court Feb. 22, 1814 with son Paschal Rutledge Administrator. His estate appears to settle 15 July 1816. They had the following children listed in probate: 1. Thomas RUTLEDGE. Listed 1st in inventory distribution list 2. Nancy DACUS Listed 2nd in inventory distribution list Nancy married William DACUS on 17 Jan 1788 in Prince Edward County, Virginia. Marriage bond on 5 Jan 1788. Bond Record spells Nancy’s name Routledge and William’s name as Davis with Nancy daughter of Joseph Routledge and Joseph Routledge as surety. Marriage Register record has Da___, William and Nancy Routledge. 3. Kiah RUTLEDGE Listed 3rd in inventory distribution list This child mentioned has been left out of every list I have seen. There is a Kiah Rutledge listed in the Georgia Census index 1820, 1830, 1840 in Morgan Co. There is also a Kiah in a tax index in 1798 in Oglethorpe, Georgia. I wonder if the name is a nickname for Hezakiah - although Kiah is the name listed in the Census and tax record. This name is incorrectly listed as Leah in several other lists of Joseph and Mary’s children. 4. Joseph RUTLEDGE Listed 4th in inventory distribution list Joseph married Ann ATWOOD on 29 Aug 1793 in Prince Edward County,Virginia. 5. Robert RUTLEDGE Listed 5th in inventory distribution list Robert married Nancy SMITHSON on 4 Jan 1800 in Lunenburg County, Virginia. 6. James RUTLEDGE. Listed 5th in inventory distribution list There are many references to this James being born in North Carolina. Joseph by reference to land records is never in North Carolina although it is possible James moved there from Prince Edward or Lunenburg. 7. Blanks RUTLEDGE Listed 7th in inventory distribution list Blanks married Polly CLAY on 17 Oct 1805 in Lunenburg County, Virginia. 8. Paschal RUTLEDGE Listed 8th in inventory distribution list Paschal was born in Virginia. His estate is probated 1836 in Marion, Perry County, Alabama. Paschal married Mary LESTER, daughter of Arichibald LESTER and Elizabeth CRYMES, of Lunenburg Co., in Virginia assumed to be in Lunenburg Co. although not listed in marriage records. Mary was born 29 Apr 1786 in Lunenburg, Virginia. She died 1869 in Marion, Perry County, Alabama. 9. Polly FILBERT Listed 9th in inventory distribution list Polly A. married John FILBERT on 21 Dec 1808 in Lunenburg County, Virginia. 10. Spencer B. RUTLEDGE Listed 10th in inventory distribution list Spencer B was born 1790 based on 1850 census of Perry Co., Alabama listing age as 60. 11. Little Berry RUTLEDGE Listed 11th in inventory distribution list Little Berry was born 1789 in Virginia. He died about Mar 1860 suppose to have been in Pickens County, South Carolina although no estate record has been found at this time. Little Berry married Nancy FARMER on 30 Dec 1812 in Lunenburg County, Virginia. Nancy was born 1793 in Virginia. She died after 1860 in possibly Greenville, Greenville, South Carolina. Little Berry is also spelled LittleBerry, L Berry, and Littleberry. Mary/Polly wife of Joseph died before Nov. 24,1819 when the court orders an appraisal of her estate in Greenville county, South Carolina. Her estate settlement appears to be final 1 February 1822. Paschal is the administrator of her estate. No papers of distribution appear in probate File No. 381 Apt. No. 6. Her sons Spencer B. Rutledge, Paschal Rutledge, LittleBerry Rutledge, all buy from the estate. Also mentioned are John Dacus, John Filbert, James Farmer, John Cureton. I assume John Filbert to be Polly’s husband. The others I make no assumption other than they are surnames of spouses. There are other buyers listed. Other thoughts on Mary: The following is an interesting will I came across that mentions a Mary Rutledge. There are some coincindences that are leading me to believe that she is the elusive Mary (Paschal). First, in all the records I have been looking for in Prince Edward I find it interesting that there is never a mention of a Paschal surname. There is a Pascal Greenhill listed in 1771 chosen to replace John Graham as a Vestryman. He could easliy have been a prominent person that Joseph and several others named son’s after. I found other marriage records of Paschal given names in the 1810’s and 1820’s in Prince Edward Co. One marriage in 1820’s listed a Paschal Leigh as father showing his given name about the same time frame as Paschal son of Joseph sr. The Paschal given name circulates several times through Joseph’s descendants. Second - Mary is given a slave named Jim. When Joseph's will is probated in 1814 there is a Jim and Nanny-Nancy. This slave couple is listed again in Mary's estate in 1819. I know there could be any number of slaves named Jim but it is possible to be the same Jim. I don’t have any account for the granddaughter Ann mentioned but I cannot seem to find anyone claiming this Mary in any other Rutledge line and Mary wife of Joseph would be married by 1777 to have daughter Nancy old enough to marry in 1788. These are only thoughts I have no proof her name is Atkins or Paschal.
