Sharing the Will of William Burke, Kent County, RI 1 Mar 1809. His son Edmund Burke was my ancestor.

Will of William Burke, Senior. Kent County, RI

In the Name of God Amen. I William Burke Senior of Warwick in the County of Kent, Taylor, being weak of body but of perfect mind and memory thanks be given to God, Calling to mind the mortality of my Body knowing that it is appointed for all men once to Die, do make and ordain this my last Will and Testament. That is to Say principally and first of all I give and recommend my Soul into the hands of Almighty God and Give it; and my body I recommend to the Earth to be Buried in a Decent Christian Burial at the Discretion of my Executors as Touching ________ Worldly Estate wherewith it hath pleased God to bless me in this Life, I give Devise and Dispose of the Same in the following manner and form:

First, I give and Devise to my beloved Wife Lydia Burke my Lot of Land whereon I now Live lying and being in Warwick, and is behind the Easterly part of Land of James Gorton and part on Job Ladd South in Land of Job Ladd, Westerly and Northerly on land of Harris Arnold and containing three acres and one hundred ________ of land be the same more or less Together with my Dwelling house wherein I now Live with all the Other Buildings on said Lot Standing. I give the above Described lot & Buildings unto my said wife for and During her Natural life only.

Secondly I also give unto my said wife the use of all my household moveable goods together with all my moveable property. Whatsoever for and during her natural life, the gifts & privileges above given to my Said Wife is in Lieu of her right of Dower in & unto my Estate.

Thirdly I give and Devise unto my son Seth Burke, all the above __________ lot of land, with all the Buildings thereon Standing, to him his heirs and assigns forever, after the Decease of my said Wife; I also give and bequeath to my son Seth all my household moveable goods together with all my personal property whatsoever after the Decease of my Said wife to him forever.

Fourthly I give and Bequeath unto my Son Richard Burke the sum of five Dollars to be paid to him by my Executors hereafter named in one year after the Decease of my wife Lydia Burke.

Fifthly I give and Bequeath unto my son William Burke Junr. The Sum of five Dollars to be paid to him by my Executor in one year after the Decease of my said Wife.

Sixthly I give and Bequeath unto my Son Edward Burke the some of five Dollars to be paid to him by my Executor in one Year after the Decease of my said Wife.

Seventhly I give and Bequeath unto my Son Edmund Burke the Sum of twenty Dollars to be paid to him by my Executor in one Year after the Decease of my said wife.

Eighthly I give and Bequeath unto my son Reuben Burke the Sum of five Dollars, to be paid to him by my Executor in one Year after the Decease of my said wife.

Ninthly I give and Bequeath unto my son Christopher Burke the Bed and furniture which I Lent to him when he first Began to keep house which he has now in is possession. I give same to him forever.

Tenthly I give and Bequeath to my son Chase Burke the Sum of Five Dollars to be paid to him by my Executor in one Year after the Decease of my said wife.

Eleventhly I give and Bequeath unto my five Grandchildren, Left by my daughter Mary Carpenter Deceased /viz/ Elizabeth Carpenter, Job Carpenter, John Carpenter, J. Cromwell Carpenter, I give to Each and every one of my above Named grandchildren fifty cents to Each of them, to be paid to him by my Executor in one Year after the Decease of my said wife.

I do hereby order my son Seth Burke to pay my Just debts and funeral Charges immediately after my Decease; and also to pay all the above mentioned Legacies within one year after the Decease of my above wife Lydia Burke. Except the Legacy herein given to my son Christopher, which he has already received.

Lastly I hereby Constitute and appoint my son Seth Burke my Sole Executor, of this my Last Will and Testament, and do give to my said Executor all the remainder part of my Estate real and personal which is not herein Disposed of. Hereby revoking and annulling all other and former Wills by me made and establishing and confirming this only to be my Last Will and Testament in Testimony whereof I do hereunto set my hand and seal the first day of March in the Year of our Lord 1809.

Signed, Sealed Published and pronounced and Declared by the said William Burke as and for his Last Will and Testament in the presents of us who at the same time at his Request in his presents and with presents of each other hereunto set our Names as witnesses to the same.

At a Court of Probate Holden in and for the town of Warwick on the 19th day of June 1809. The Instrument hereunto ________ purporting the last Will and Testament of William Burke Late of Warwick Deceased was presented to this Court for Probate; and Nathan Arnold, Harris Arnold, and Job Ladd subscribing witnesses to said Instrument being present declared upon oath that they in their presence of Each other and in the presence of the said Dec’d. Saw and heard him the said William Burke Sign Seal publish announce and declare the said Instrument to be the Last Will and Testament that he appeared at the same time to be of a Sound Disposing mind & Memory, And the court having Examined the said Instrument and the evidence, Relative to the Execution thereof do Consider that Said Instrument is proved and we accordingly approve and ________ of said Instrument; and do order and Decree that the same be recorded as and for the Last Will and Testament of said Deceased.
