Obituary:
Departed this life on Friday the 20 inst, in this place, Mrs. Elizabeth Ward mother of Dr. William and Col. Matt War. The deceased had long been confined to her bed with both age and affliction. She was the mother of many sons and daughters that stand high in the estimation of their neighbors and friends, which is proof of her good example in this world as a mother, and a christian. She departed from among us, to join the Sapernal host whither our fathers have gone.

We sympathise with her friends and relatives in their loss but the earth claims its own, and the tomb is the end of the earth, for dust thou art, and unto dust thou shalt return, and the spirit to God who gave it. Gilmer Star

LAST WILL AND TESTAMENT OF MARTIN WARD

STATE OF ALABAMA
COUNTY OF WALKER

       Whereas I Martin Ward of the County and Sate aforesaid, being in bad health, but of sound mind, but knowing that all men must die, and wishing to dispose of my worldly effects, as circustances seem to dictate make and declare this my last will and testament following, that is to say.
       1st----- It is my wish that my executors should first pay out of my said estate, my burial expenses in a suitable manner.
       2nd-----It give to my wife Nancy I Ward (Nancy Wood is Martin's second wife) my negro girl Amanda and her children they being in lieu of six hundred and forty dollars by me received from her Mother's Estate upon our marriage, Also I give her the tract of land on which I now reside. it being a part of the SE1/4 of the NE 1/4 of the SE1/4 of Section 26, in township 13 Range 4 Wesst-Being all of the above described quarters that lie in the East-side of the Mulberry Fork of the Warrior River, containing forty five acres more or less, Also the E 1/2 of the NE 1/4 and the W1/2 of the North East-quarter of section 25. Township 13 Range 4 West-Containing one hundred and sixty acres more or less, Including the farm and residence; also the household and kitchen furniture, also a horse and buggy to be worth three hundred dollars, Also four Cows and calves, twenty head of stock hogs, Ten head of sheep. All of which she is to have and to hold as her own property in fee simple, to use and enjoy as she desires, except the lands above described, which she is to have and to hold exercising all the right of ownership over it, togethere with all the hereditaments and appurtenances there to belonging during her natural life, but after ther death and said land and appurtenances as above described shall be sold for the use and benefit of my children, and proceeds divided among them so as to make them equal.
       3rd-----I give and bequeath unto my son Matthias Ward four hundred and fifty dollars which he has already received, and for which I hold no receipt. Also three hundred and twenty dollars in Texas lands which has already been deeded to him.
       4th-----I give and bequeath unto my son John L Ward, Seven hundred and Seventy dollars which he has already received, and for which he has receipt.
       5th-----i give and bequeath unto my daughter Margaret Templeton (Margaret Corneius Ward) the sum of four hundred and fifty dollars, which she has received, also three hundred and twenty dollars paid her in Texas lands which has been deeded to her.
       6th-----I give and bequeath unto my daughter Martha Jones (Martha Minerva Ward) the sum of four hundred and fifty dollars which she has received and receipted for. She has yet to receive three hundred and twenty dollars, to make her equal with the other heirs.
       7th-----I give and bequeath unto my son Reuben R Ward, the sum of seven hundred and seventy dollars which he has received and receipted for, also a certain parcel of lands known at the Huntsville Land Office as the NW 1/4 of NW 1/4 section 25, Township 13 Range 4 West, and the N 1/2 of the NW 1/4 section 24 Township 13 Range 4 West containing one hundred and twenty acres more or less. Also a part of the E 1/2 of SE 1/4 lying on the east side of the Mulberry River containing fifteen acres more or less which the said Reuben R Ward is to have for the sum of four hundred dollars without interest and to account for in the settlement of my estate.
       8th-----It is my will that my executors shall pay all my just debts if anything there be owing out of the sale of such property as may appear most appropriate.
       9th-----It is further my will that all my effects both real and personel remaining after allowing and setting apart the portions mentioned in this will shall be equally divided among my said children as heretofore mentioned.
       10th---It is also my will that no administration shall be had on my said estate, further than the probation of the said will and the Registration of said property belonging to my estate.
       11th---It is my desire that my wife Nancy I. Ward and my son Rueben R. Ward shall act as my Executors to carry out the provisions of this will, and I do hereby appoint them for that purpose.
       12th---In conclusion, I declare this tro be my last will and testament, and hereby revoke and make null, and void all other wills heretofore made by me, in testimony whereof i have hereunto set my hand and seal using a scroll for a seal in presence of the following subscribing witnesses this 10th day of April A.D.1863.

I whitness whereof i have hereunto set my hand and affixed the seal of said Court this the ___ day of December A. D. 1865.

       Ing the matter of the estate of Martin Ward, Dec'd
       Present, Hon E. G. Alldredge, Judge of Probate.

       This being the day appointed for hearing the application in writing, and under oath, of John F. Sandlin, Administrator of the Estate of Martin Ward, Deceased, for an order to sell certain lands of said estate, hereinafter described, for making an equitable division among the heirs and devisees, such application showing that Mrs. Nannie griffith, an heir, desired such division. Now come the said petitioner and mover the Court that said application be granted. An it appearing to the Court that margaret E. Drennen, Mary C Byars, Nannie Griffith, Fannie Johnston, Ella Gibbs, and John Sandlin, who are heirs and devisees of full age, and residing in this state, have been duly notified of said application and the day and place set for hearing the same by citations served upon them not less than 10 days before this day except as to John Sandlin, who is the petitioner in this cause. And it further appearing to the Court that Matthias Ward, Deceased, was the eldest son of Martin Ward, deceased, and that the said Matthias Ward left surviving him, Dr. W.L. Ward, a son; M.L. Ward, as son; W.C. Ward, a son; J.M. Ward, a son Mrs. Bettie Pickard, a daughter; and the children of Houston Ward, Deceased, the said Houston Ward, having been a son of the said Matthias Ward, and the said Children of the said Houston Ward being Mrs. Mary Miller, a daughter, J.C. Ward a son, R. Ward, a son; Matt Ward, a son and _______Ward a son all of who are over the ages of twenty one years, respectively and are non-residents of the State of Alabama, and reside in the States of Texas, and Oklahoma, and that the aforesaid persons own and undivided one-fifth interest in the estate of the said Martin Ward, Deceased, subject, however, to advances made to the said Matthias Ward in his life time by the said Martin Ward as per the terms of the Will of the said Martin Ward, a copy of which is annexed to the petition in this cause as Exhibit "A".
       It further appearing to the Court that John L Ward, Dec'd, was the second son of the said Martin Ward, D"ec'd., and that the said John L. Ward left surviving him Levi Ward, a son; Matthias Ward, a son; and Malinda Edleman, a daughter, all of whom are over the age respectively of twenty one years, and of sound mind, non-residents of the State of Alabama, and reside at Itally, in the State of Texas, and that the said childdren of John L. Ward are entitled to received the distributive share to which the said John L. Ward would have been entitled to receive, subject, however, to an advancement made to the said John L. Ward, by the said Martin Ward in his life time, which is particularly described in the Will of Martin Ward, a Copy of which is attached to the petition in this cause.
       And it further appearing to the Court, that Mrs. Margaret Templeton, who is now deceased, was a daughter of the said Martin Templeton, who is now deceased, was a daughter of the said Martin Templeton, who is now deceased, was a daughter of the said Martin Ward, and left J. A. Templeton, a son; Howard Templeton, a son; and Mattie Pickens, a daughter; Annie Thompson, a daughter. All of whom are over the ages respectively of twenty one years, and of sound mind, residing at Brasher, in the State of Texas and are entitled to receive one-fifth interest in said estate of Martin Ward, Dec'd, subject to advancements made by the said Martin Ward in his lifetime to his several heirs, which are particularly described in the Will of the said Martin Ward, a copy of which is attached to the original petition on file in this cause.
       It further appearing to the Court that Martha Jones, Deceased, a daughter of the said Martin Ward, in addition to the aforementioned persons, who reside in Alabama, left surviving her, A.B. Jones, a son, who is over the age of twenty one years, of sound mind, residing at Hemphill, Sabine Co. Texas, and that the said A.B. Jones, together with Margaret E Drennen, Mary C Byars, Nannie Griffith, Fannie Johnston, and Ella Gibbs, are entitled to receive one-fifth interest in and to the estate of the said Martin Ward, Deceased, subject only to the advancements made by the said Martin Ward in his life time to his several heirs as appears in Martin Ward's Will, a copy of which is annexed to the original petition on file in this cause.
       It further appearing to the Court that R.R. Ward, Deceased, had before his death conveyed his interest in said estate to John F. Sandlin, by deed, which said deed is attached to the original petition on file in this cause, and by the terms of said deed, the said John Sandlin, owns one-fifth interest, in and to the estate of the said Martin Ward, Deceased, subject only to the advancements made by the said Martin Ward, to his several heirs in his life time which are particularly described in the will of Martin Ward, a copy of which is annexed to the original petition on file in this case. and it appearing to the Court that all of said heirs and devisees aforesaid who reside out of this state have been brought into Court by having been duly notified of this application, and the day and the place set for hearing the same, by publication of notice to them directly, once a week, for three successive weeks in the Southern Democrat, a newspaper published in the siad Blount County, Alabama.
       And it appearing to the satisfaction of the Court from the evidence taken by the depositions of C.L. Roberson, T.M. Byars, and S.C. Robbins disinterested witnesses, and of John F. Sandlin, the petitioner, as in Chancery proceedings, that the lands mentioned in said application of which the said deceased, died seized and possessed, described as follows: The East half of the North West Quarter, and the West Half of the NorthEast Quarter of Section 25, and all that part of the East half of the South East quarter, lying of the East side of the Mulbery River, in Section 26, all in Township 13, Range 4 West in Blount County, Alabama, cannot be equitably divided among said heirs and devisees, and that a sale thereof is necessary for making an equitable division among heirs and devisees.
       It is therefore ordered by the Court that said application be granted and the said John F Sandlin, as such Administrator, is hereby ordered to sell the above described lands between the hours of eleven o'clock in the forenoon, and 4 o'clock in the afternoon, on the 6th day of May, 1918. in front of the Court house door in the town of Oneonta, Alabama, at public sale to the highest bidder, after first having given notice of the day, place and terms of said sale and a descritption of the land for three successive weeks in the Southern Democrat, a weekly newspaper published in said County,said sale to be made for cash, and that he make report under oath of said sale to this Court, within thirty days after the same is made
