Not my lineage, but I have a transcribed copy so sharing. In the name of God, Amen: I Walter Pitts of the County of Halifax and province of North Carolina sick of body but of perfectlyly sound mind and memory blessed by the Lord for it and knowing it is appointed for all men once to die and for the better prevented contraversied and disputes that shall arise hereafter I do make and ordain this to be my last Will and Testament, first of all I give my soul into the hands of All Mighty God who was the giver of it and for the body to be buried after a Christian like manner which I shall leave to the discretion of my exec and exect'x hereafter mentioned and as for what worldly goods it hath pleased the Lord to bless me with. I give and bequeath in manner and form following ---- Imprimes, I give and bequeath to my son Hard Pitts, three hundred and twenty dollars of purchase patent land lying on the south side of Conway Creek and one negro called Bobb and one ball faced mare that he has in possession, one feather bedd, and furniture that he now lies upon and two cows and calves and my whip saw and cross-cut saw and all my carpenters and capers tools and ten pounds to be paid in gold or silver, all to him and his heirs forever. Item, I give and bequeath to my son Mark Pitts four hundred acres of land joyning my son Hard Pitts' land and two negroes the one named Sam and the other named Phillip, and one feather bedd and furniture and ten pounds to be paid in gold or silver all to his and his heirs forever. Item, I give and bequeath to my son Lewis Pitts, three hundred and nine acres of land beginning in the middle of the lower line between Fishing Creek and Conway Creek then bearing straight to the upper line so as to contain the aforesaid three hundred and nine acres joyning to Conway Creek and I give him one negro called Tom and twenty pounds prov. money and also ten pounds to be paid in gold or silver to him and his heirs forever. Item, I give and bequeath to my son Henry Pitts the remaining part of that tract of land that I have given to my son Lewis Pitts, also I give him two negroes one called Peter, the other Rachel also I give him ten pounds prov. and ten pounds to be paid in gold and silver all to him and his heirs forever. Item. I give and bequeath to my son John one negro called Ben and my Will but that it shall be moved nor hired out until he shall arive to years to choose a guardian and also I give him ten pounds to be paid in gold or silver all to him and his heirs forever. Item, I give and bequeath to my daughter Tamer Pitts two negroes called Lidd, one called old Lidd and the other called young Lidd, and my sorrell pacing mare and one side sadle and bridle and ten pounds to be paid in gold or silver and one feather bed that is called hers and also two cows and calves to her and her heirs forever. Item, I give and bequeath to my daughter Silvia Pitts two negroes the one called Aggy, and the other called Ned and one black horse and one side sadle and bridle and one feather bed and furniture and two cows and calves and ten pounds to be paid in gold or silver all to her and her heirs forever. Item, I give and bequeath to my daughter Patiena Pitts one negro called Barbary and also ten pounds to be paid in gold or silver all to her and her heirs forever. Item, I give and bequeath to the child that my wife goes with now one negro called Beck and also ten pounds to be paid in gold or silver all to it, its heirs and assigns forever. Item, I lend to my beloved wife Martha Pitts the manor or plantation whereon we now live also I lend her my negro Amey and Tenny and Jack and man during her life and also I lend her my negroes Sip and Badlam during her widowhood and as for the rest of my estate which I have not given away I give to her to her own disposial now after the marriage or death of my beloved wife Martha Pitts what I have lent her I leave to be divided between her three children. Now if my wife should be dlivered of a son he shall have one half of the manor plantation with his brother John Pitts, but if a daughter only to have other part of the estate lent to my beloved wife and it is not my well desire that any of my estate should be sold but that my lawful debts should be paid out of it by my executor and executrix and that should every particular childs part together without selling it for them until they shall come of age to take it to themselves and I do appoint Wilson Williams to have the care and management of my son Henry Pitts and all his estate until he shall arive to the age of twenty one years and I do further more consitute and appoint my beloved wife Martha Pitts my executrix and my son Hard Pitts my executor of this my last will and testiment. In witness whereof I have hereunto sett my hand and seal this tenth day of February one thousand and seven hundred and seventy. Signed Walter (his mark) Pitts. Signed, sealed as to my Last Will and Testament In the presence of John Williams, Thomas (his mark) Hill, Sr., Jesse Williams, Francis Williams (his mark) HALIFAX COUNTY, May Court 1770, Then this Will was Exhibited in open court by the Executors and Duly Proved by the oaths of John Williams, and Jesse Williams two of the subscribing witnesses hereto who on their oaths did say that they saw the Testator Walter Pitts sign, Publish and Declare the same to be his last Will and Testament and they gogether with other witnesses as subscribed severally their respective names as witnesses thereto in the presents of the Testator and his request whereupon the said Will was ordered to be recorded.
