"In October 1637, the ship Elizabeth, alias The Old Leamman, sailed from London to Virginia, with Benjamin Woolmer as master.However when the ship was about one hundred and fifty leagues off the coast of Virginia, it was surprised by a Spanish fleet of eleven vessels - half of which belonged to the State fleet under the command of the Marques de Gardines. Under the pretense that the King of Spain would not allow them to inhabit Virginia since it belonged to him, the Marques took crew, vessel and passengers of the Elizabeth back to Cadiz, where Woolmer and Leigh one of the crew were put on bail of L4,000. The English Ambassador at Madrid, Sir Walter Austen, made many determined efforts to get them released and their goods returned. Woolmer actually remained at Madrid two months longer in the hope of finding a settlement, but failing in this, returned to England. Leigh returned from Madrid with letters to the Judge of the Spanish Admiralty Court at Seville, but these too, proved fruitless.

The way this reads Richard Perrin had already been living in Virginia, and he was trying to return when this happened.
