I, Abner Houchins of Louisa, first debts to be paid, second I lend to my wife, Ann Houchins, all of my Estate, both real and personal, to wit: the tract of land on which I live, all of my negroes, Peter, Werter, Spencer, Norbon, Frances and her child, Julian, and their increase during her life. I also lend to her all of my household furniture and kitchen furniture, stock, plantation, tools, crop, etc. At the death of my wife, Ann Houchins, it is my wish and desire that my executor hereafter mentioned should sell all of my estate, real and personal, and divide it among my negroes. I also wish my negroes to select their master. Should any of my negroes be disobedient to my wife it is my wish they should be sold and forfeit all claims they may have on my estate. Should my wife be compelled to sell any one of my Negroes from misbehavior it is my wish the money should be appropriated to the purchase of another negro.
In a codicil to his will dated Nov. 22, 1849, Abner gave to his wife, in fee simple, a tract of land known as Dudley's Tract, but now called Morrison's Gold Mine.

In 1864 John Chiles Houchins, Lewis & Nancy Thomasson, & John & Sally Kiger filed a petition to claim the estate of Abner Houchins as follows.

...Petitioner that he supposed all his said relatives were dead as he had written to them repeatedly since he had heard from his brother James, but could hear nothing from or about any of them. Your petitioners are also advised that the presumption of law is that all of the said next of kin of the testator (Abner) are dead, none of them having been heard from for more than seven years- and they insist that the testator so believed not only from his declaration stated above but from the fact that he directed the whole of his estate real and personal after his death of his wife should be sold and divided among his negroes. Your petitioners for this show that the said cause came on for hearing at the April term 1864 of said court upon the bill & exhibit and on order of publications as to the absent & unknown defendants, none of whom appeared- when upon it was held that the bequest to the slaves of testator was void and of no effect- and a ..... was entered to that effect and the whole estate of the testator including his slaves was ordered to be sold & the proceeds their of divided among his heirs at law and legal distributor, all of which will since fully appear from .... which is prayed to be taken as a part of this petition. Your petitioners further show that the brothers and sisters, father & mother of the said Abner Houchins being dead, the former unmarried & without issue, they, your petitioners, are the heirs at law, next of kin and legal distributees of the testator under said ... That the grandfather of the said testator was Frank Houchins who with his wife are both dead, leaving the following children, Edward (father of said testator), Stephen, John, Frank and William. That John & William dec'd many years go unmarried & without issue. Stephen married & died as did also his wife in the life time of the testator, leaving the following children, your petitioner John C. Houchins, Martha A. & Mary. Of whom Martha A. has recently died unmarried & without issue. Frank Houchins died leaving the following children (but no wife surviving), Wilson Houchins- also dead leaving children whose names & number are unknown., your petitioner Nancy wife of your petitioner Lewis Thomasson, Sally wife of John Kiger, Frank who is also dead leaving children whose names & numbers are unknown. Henry who died childless. Your petitioner pray there fore to be admitted parties defendant in said suit, and to be allowed to file .... and to do whatever is necessary to protect their interests. They also pray that it may be referred to one of the comm.. of the court to ascertain who are the heirs and distributees of the said Abner Houchins dec'd. and that your petitioner may have their portion in said estate allotted & paid over tothem. and your petitioners will ever pray....
