He was the heir to another Samuel Spencer. Judge Samuel Spencer had one son only, William Samuel Spencer, who settled his father's estate when he came of age as "heir at law" of Judge Spencer. Very oddly, he did not mention a mother or a widow in the estate settlement (there is no recorded will), and no part of the estate was set aside for the widow, the presumed Sybil Tisdale. This made me suspect divorce, but N. C. records to not have a divorce for this pair. That said, according to legal records, she inherited nothing whatever from her husband, which surely must be against the law unless she had done something that disbarred her from a widow's portion.

I must add that I do not accept that Sybil Tisdale was the only wife of Samuel Spencer. The DAR is adamant that his wife was Sarah Daniel, and the descendants of Spsncer's eldest daughter Mary Spencer Jackson all declared that Mary's mother was Sybil Pegues. That said, Tisdale had to be the second wife, and how and why she got left out of the estate is a mystery. I have researched this family thoroughly and found no reference to the name Griffin.
