To the worshipful Court of Mecklenburg County in chancery sitting;Humbly complaining sheweth to your Worships your Orator William Harristhat sometime in the year of our Lord one thousand eight hundred and three your orator's Father James Harris departed this life leaving the following children to wit,
Sarah Owen wife of Sharod Owen*****
Mastin Harris
Dicea Allgood wife of Jeremiah Allgood,
Polly,
Betsy
Fanny
Patsy
Jane
Tempe
and James Harris.
That the said James Harris having duly made and published his last will and testament which is recorded in Mecklenburg County Court, devised all his estate both realand personal except a negro boy named Mark to his wife Martha Harris during the term of her natural life, and after the death of the said Martha directed his estate should be equally divided among his children with this proviso to witthat if the negro boy Mark whom he devised to James Harris should die before the said James attained the age of twenty one years then that the said James should have an equal share of his estate but if the negro boy Mark should not die before the said James attained his age of twenty one years, then and in that case that the said James should have no part of his estate lent to his wife.Your orator further states that the said James Harris at the time of his death was seized and possessed of a tract of land and several slaves within the jurisdiction of this court; that Martha Harris qualified as executrix and Reuben Harris as executor of the last will and testament.
The separate answer of James Harris an infant under the age of twenty one years, who answers by Reuben Harris his guardian to a bill of complaint exhibited against him and others by William Harris in Mecklenburg county court.
This deponent saving and reserving to himself all manner of benefit of exception to the man errors and uncertainties in the said bill contained, for answer thereto, or to so much thereof as he is advised it is material forhim to answer, he answers and saith:That he admits as stated in the complainants bill, that he is entitled to an equal share of the estate of James Harris the father of this respondent, only upon the event of the negro Mark's death before this respondent attains his age of twenty one years, but as this event ma take place, this respondent hopes that this worshipful Court whose peculiar province it is to protect the rights and interests of infants, will decree that the legatees of James Harris deceased shall give bond and security to the executors of James Harris, to refund their equal proportions of the share this respondent may become entitled to upon the death of the negro Mark before this respondent attaining his age of twenty one years as aforesaid.And this respondent having fully answered prays to be hence dismissed with his reasonable costs in this behalf expended.
