Phelps Prepares to Counter Unexpected Move of Defense in Entering Plea of Not Guilty When Arraigned for Bank Raid
The trial of the three Manter bank bandits, John Walker, Claude Ray and Andrew Halliday, who on Monday pleaded not guilty to charges of first degree murder in the slaying of C. A. Hickman, Kiowa county deputy sheriff, will undoubtedly be prolonged into an involved legal battle with enormous additional expense to the county, according to a statement Wednesday from J. Arthur Phelps, district attorney.
According to Phelps, first steps in the unwinding of legal technicalities will begin Saturday at the hearing before District Judge James A. Park to determine whether or not the defendants’ attorney, Thomas R. Hoffmire, shall be supplied with a copy of the confession which the bandits are alleged to have made to the district attorney.
A copy of the confession in the hands of the defense counsel would act as an obstacle toward a speedy prosecution, Phelps said.
In the meantime, Hoffmire has announced that he has demanded a copy of the confessions, and has been refused. This action will only delay matters, he states, because he will without doubt ask that the trial be held up in order to give him an opportunity to examine the papers. He has requested of Judge James A. Park and Judge Samuel D. T. Trimble, district judges, a court order giving him access to the confessions.
It was definitely announced Wednesday that District Judge Trimble will try the cases of the bank bandits.
The unanticipated plea of not guilty entered in district court at Eads is following a conference with Hoffmire, needed a complete rearrangement of plans for conducting the case, it was announced. Additional evidence and a more exhausting investigation will also be necessary.
Several important witnesses will be transported from Kansas to offer testimony at the trial which will open at Eads April 8. It was previously believed that no such procedure would be necessary, Phelps said.
While investigation at the present time has not reached a stage of development whereby the prosecution can confidently anticipate a death penalty, Phelps declared that every effort is being made to establish evidence which will result in conviction.

DENVER, March—26.—(AP)—Four men were taken to the state penitentiary today to begin serving sentences in the west side criminal court here, including Ralph Bergdoriff, reputed “king of the Coloradobootleggers.” Who will serve four to five years for ownership, possession and operation of a still. The other three were John Murray, seven to ten years for burglary, Jack McCarthy, one to three years for operation of a confidence game, and H. A. Chabannes, one to three years for operation of a still.
