I researched the Capital Democrat newspaper. I found that the ex sheriff was murdered in 1921. See the CD August 4, 1921 for the story. He was shot 4 times with a 44 caliber revolver, double action. Shot by J. W. Phillips. Shot at the corner of Main and Kemp in Tishomingo as he was about to go into Casey's drugstore. If you get the CD, follow it for weeks and weeks to get the whole story. Phippips was convicted of murder, sentenced on March 30, 1922 to die, and was due to be electrocuted at McCallister Prison in June, but that was being reviewed. I am still reading the CD's on microfilm to see if he WAS executed.
