"The grand jury at the March term of 1820, Ezra Osborn presiding, found only
two bills of indictment:one against Mr. Enoch LOPER for assault & battery
upon the body of one John HULL, and one against John HULL for assault and
battery upon the body of Enoch LOPER.HULL entered a plea of guilty and was
fined one dollar and costs.In the case of Enoch LOPER, the prosecuting
attorney, John DOLAN, Esq., who seemed to have become disgusted with the
manner in which justice was being administered by the court, suggested that
a nolli prosequi be entered upon the LOPER indictment; thereupon DOLAN
resigned and Richard STILLWELL, Esq. was appointed in his stead.
From the frequency in which LOPER's name appears upon the court records, we
take it that on all public occasions he was inclined to be quarrelsome and
contentious, particularly when well primed with the aqua vitae of that
period which was plenty and cheap, and handed around and freely imbibed in
at all public gatherings and by nearly all of our people.At these
gatherings if was the fashion to bring up and settle questions of
differences and veracity between men, by a resort to the fist, foot, teeth
and thumb--thumping, kicking, biting and gouging one another."
Page 53:John HULL is named as a voter at an election held 5 Feb 1820 in
Deerfield Twp.The number of votes cast at this election was forty named
"pioneers".
