LAST WILL AND TESTAMENT OF SUSAN OLDFIELD OF ROME, New York, dated 14 Dec 1876

Oneida County Will Book 28, page 173

I, SUSAN OLDFIELD, of Rome, New York, being of sound mind and memory and desirous of disposing of all of my property, do make, publish and declare the following as and for my last will and testament.

First, I will and devise unto my son HENRY OLDFIELD that certain lot of land owned by me, on which are a house and barn, situate on the northerly side of Bloomfield Street in Rome and between James Street and Black River Canal, said lot and premises being next easterly of the land now owned by my said son HENRY, and which lot and premises so devised are thirty three feet front on Bloomfield Street, same width in rear, and one hundred and fifty deep, more or less. There is upon said lot, and also covering a lot of same size next east of it, also owned by me, a mortgage to Dr. M. C. West of $300. The lot so devised to my son HENRY is conveyed subject to and (he?) charged with the full payment of the whole of said mortgage and interest so as to lease the lot next east of it free and clear.

I also will and bequeath unto my said son HENRY my household furniture, wagon and all other personal [property](except sewing machine as hereafter mentioned) and in consideration of foregoing he is charged with the payment of said mortgage and all other debts of mine including funeral expenses.

Second, I further will, devise and bequeath unto EDWARD OLDFIELD of Rome (son of JOHN OLDFIELD, my husband's son) the sum of one hundred dollars, to be paid out of the sale of the lot next east of the one hereby devised to my son HENRY. I hereby authorize and empower my executors hereinafter named to sell and by good deeds of conveyance to convey all of the real estate I own not herein devised to HENRY OLDFIELD, and from the proceeds of such sale pay said EDWARD the said $100, and all the rest, residue and balance of said proceeds to divide equally, share and share alike, between the following named four children of mine, viz.: MARY ZERVAH FARR, now of Rome, N. Y., GEORGE OLDFIELD, now of Rome, N. Y.; CAROLINE HEITZ, now of Oshkosh, Wisconsin; HARRIET SEYMOUR, now of Rochester.

I make this provision for said EDWARD because he has ever been kind to me, and because he advanced to me $100 to help pay for said premises, and this devise or bequest to him is in lieu and full satisfaction of and from all claims he may have against me or against my estate. The said executors to sell said real estate as soon as in their judgment a good opportunity presents itself.

Third, I hereby nominate and appoint my said son HENRY OLDFIELD and Dr. M. C. WEST, both of Rome, executors of this, my last will and testament, and in case of death, refusal to serve of either, then the acting executor to have full power and authority in the premises as if both acted.

And I direct my said executors to sell the sewing machine now owned by me and use the proceeds to procure and erect a suitable headstone to be placed at the grave of my deceased daughter Emma M., now buried in the cemetery or burying ground in Rome.

In witness whereof I have this 14th day of December, 1876, signed my name and affixed my seal.

We whose names are hereto subscribed do certify that SUSAN OLDFIELD, the testatrix, subscribed her name to this instrument in our presence and in the presence of each of us and at the same time she declared in our presence and hearing that the same was her last will and testament and requested us and each of us to sign our names hereto as attesting witnesses to the execution thereof, which we have done accordingly in the presence of the testatrix and of each other the day of the date of the said will.
