In The Names of God, Amen. I BILLEY WILLIAMS of Nash County, and State of North Carolina, do ordain and make this my last will and testament this the tenth day of April in the year of our Lord, one thousand eight hundred and four. Being of sound mind and memory calling to mind there is appointed time for all men once to die, first and four most place I give my soul to God that gave it and my body to be buried in a christian manner by my executor hereafter mentioned and after my funeral charges and all my just debts paid calling to mind that God hath pleased to bless me with give and disposeth in the following manner and form as followeth to wit:

Item: I lend unto my beloved wife CHARITY WILLIAMS the land and plantation whereon I now live and one more tract of land on the beaver dam of one hundred acres and two negros by the name of PEG and JYP, and ? cows and calves, and choice of my horses, five sows and twenty dry hogs all my household and kitchen furniture and my mill and grindstone and one saddle and my cider barrells during her life time or widowhood and all my working tools.

Item: I give unto my beloved son SAMMUEL WILLIAMS, two tracts of land lying on Toisnot swamp called and known by the name of the Old Place and the Merry Branch place to him and his heirs forever.

Item: I give unto my beloved son DRURY WILLIAMS, three tracts of land, one called and known by the Coulson Place, one tract on the beaver dam on both sides of the fox branch, and one tract on the Jumper to him and his heirs forever.

Item: I give unto my beloved son WILLIAM M. WILLIAMS, the land and plantation whereon I now live and in tract joining John Eatman after the death of his mother or widowhood to him and his heirs forever.

Item: I give unto my beloved daughter TRACEY KENT, sixty silver dollars to her and her heirs forever.

Item: I give unto my eight youngest children, all the remainder of my stock to be sold and the money to be equally divided between them and their heirs forever.

Item: I give unto my beloved wife Charity Williams, three hundred silver dollars to her forever.

Item: I give the balance of my money, notes and accounts to be equally divided between all my children.

Item: I give the rest of my negroes not mentioned to be equally divided between my eight children to wit: LUCY WILLIAMS, SAMUEL WILLIAMS, NANCY WILLIAMS, MORNING WILLIAMS, DRURY WILLIAMS, WILLIAM M. WILLIAMS, CHRISEY WILLIAMS and BUNCH WILLIAMS, them and their heirs forever.

Item: I give unto my beloved daughter Bunch Williams, one tract of land lying on the Beaver Dam containing one hundred acres more or less after the life time or widowhood of her mother to her and her heirs forever, and all the legacy that I lent to my wife except the land is after her death or widowhood to be equally divided between all my children to them and their heirs forever. I do appoint make and ordain my friends my wife Charity Williams and my brother DRURY WILLIAMS and Noel Eatman my holey executors to this my last will and testament the day and year first above written.

Signed, sealed and acknowledged in the presents of James Browne, Bidy Eaton, Burnwell Kent.

The foregoing will was duly proven in open court by the oath of James Brown and Bidy Eatman, two subscribing witnesses thereto and on motion ordered to be recorded, and is registered in obedience to the above order.
