John Montgomery [d: 1778]; wife Ann. Unknown connection with George, Elisabeth

One John Montgomery is known from a Mecklenburg Co, NC, court record of January 1779 and Loose Estate Papers, but little has been learned of him. In court, Ann Montgomery, widow and relict of John Montgomery, deceased, resigned her right to administer on the personal estate in favor of George Montgomery and Thomas Harris. These two posted bond (£4,000) having John Flanikan and Adam Alexander as their securities. That was 11 Jan 1779, the first court session of the year. John Montgomery probably had died near the end of 1778. He signed a note on 4 August 1778.

The Loose Estate Papers of John Montgomery of Mecklenburg Co, NC, included a note signed 31 Oct 1777 by him and another person whose name is torn from the paper all but a final "on", another was signed 6 July 1778, and a third on 4 August 1778. The file includes debts and receipts. A committee was appointed to settle the estate. They had to deal with paper money which appears to have been worth about 3% of its value when liquidated as well as specie (hard currency). The Committee found the demand vouchers totaled £261-4-2. The estate was worth £1681-2-6½ which amounted only to £56-9-0. The summary was signed by John McCorkel and Edwd Giles.

The names of creditors appear, often in a variety of spellings, as Sarah Hutchison (butter, in August 1778), William Pickens, Mary Ormond, James Witherspoon Junior (balance of an account), Ebenezer Miller, James Shanks, John Deyermond (Dermon, Dermond), George Harkness, John Jack (work done on wagon and other), Robt Lewis (small balance on an account), William Brown (butter and shoemaker work), Alexander McKee (butter, oats, wheat, beef, tallow), John Mulwee, James Simeson (lengthy account included two spinning wheels, cash in Charlestown, tallow, corn, six acres of corn fodder, wheat, salt, oats, 2 1/2 pints of whiskey, 1 1/2 gallons of rum), Will McGowen (McGowan), Samuel Brown (butter), Thomas Harris, John Witherspoon (for stabling of two horses in Charleston for two nights and 2 bushels of corn), William Mathews (Mathes), Joseph Reed, Jeremiah McWhorter (butter), Thomas Adkins (Adtikins), James Ramsey.

The three Montgomerys named in the papers were Ann (signed with her mark on 4 Feb 1780), George (co-executor), and Elisabeth (for a mare at £9 and two cows and calves at £8 and interest from 1776 £6 14 shillings. Signed with an "E" before Thomas Harris JP.) George is absent from Mecklenburg Co, NC, land and court records after October 1790, but he appeared at court in Feb and May 1813 to prove deeds.

Nothing in the estate papers indicates that John owned land. Listed in the same tax district as George Montgomery in 1790 were seven names also found among John Montgomery's estate papers. It is likely that John and Ann had resided in southern Mecklenburg Co, NC, and that George did so too for a few years.

There is a one-page account of what the estate of "John Mongumery Decest" owed "George Mongumry in Specie". He himself signed his name "George Montgomry". The account seems to cover the time from June 1776. [Elisabeth's account also shows interest from 1776.] George Montgomery appeared 3 March 1784 before Thomas Harris JP to make an oath that the account was "just and true". Two horses £67, cash lent £10, "Driving a wagon 2 year & a half at £30 pr year -- £75", "the use of horse in the wagon 2 years and a half £45", "Cas(h) when we Lived at the saw mill" £3, 1 mare £10, Cash answered to Will Elliott £3, "1 ginuee paid Jas Harris" £1/17/4, £5 "south money paid Mr Shir at Camden" [that is, South Carolina money].

It is possible that George was figuring 2½ years as June 1776-December 1778 which would fit with a date of death in time to file the will at the Jan 1779 term. But what happened in June 1776? Is that when John and Ann moved to Mecklenburg Co? How were George and Elisabeth connected?

George Montgomery witnessed a deed whereby Thomas Sharp of Tryon Co, NC, [formed 1774 from Mecklenburg Co, NC] sold to Joseph Kennedy of Mecklenburg Co, NC, a PA warrant for 300 acres in Lancaster Co, PA (now Dauphin Co). (The other witness was Agness Graham [Deeds 7, pp 68-69]. Missing are the dates the deed was signed and probated, but Kennedy left the land in Hanover Township in PA in his LW&T of April 1777 to wife and sons.

On 27 July 1779, George Montgomery and William Black witnessed a deed whereby land of John Johnston (wife Ann) was sold to John Smith in Lofton's Bottom on McAlpine Creek adjoining Fleniken (Deeds 10, p 390).

In July 1783, George Montgomery won a suit, heard by a twelve-man jury, against Jamison and Lowery for 1 pence plus 6 pence costs. At the same time the Estate of Montgomery won against Will Miller for 1 pence plus costs for "default". In April 1784, George Montgomery won more suits against James Kennedy and John Flenniken, Pritchert and McCulloh, and Lemonds and McGee, all for 1 pence plus 6 pence costs.

George Montgomery witnessed three deeds whereby land of Peter Johnston was sold to Francis Hodge, including, on 9 March 1785 (Book 19, p 245) land between McAlpine and Four Mile Creek (George appeared at court in Feb 1813 to prove this deed); on 17 March 1785 (Deeds 19, p 281) land on McAlpine Creek (George appeared at court in May 1813 to prove this deed); and also on 17 March 1785 (Deeds 13, p 682) 100 acres on McMichaels Creek (George appeared at court in July 1789 to prove this deed).

On 26 Dec 1786, George Montgomery witnessed a deed along with Jos Kennedy and John Johnson whereby land of John McGaughey of Lincoln Co was sold to Daniel Benham (Deeds 13, p 169). George proved the deed in court Oct 1787.

On 1 Aug 1787, George Montgomery and John Harris witnessed a deed whereby land on Four Mile Creek of James Johnston Jr (wife Elizabeth) was sold to Hugh Harris (Deeds 13, p 708).

1790 census, page 383 George Montgomery Page 383. George was in the 18th of 19 tax districts into which the census was arranged.

References to George continue, some of them involving jury duty (Oct 1784, Oct 1787, April 1788, April 1790, Oct 1790) or small suits (April 1789, Davis and Flannekin v James Yandle and George Montgomery; Oct 1790, Wm Veach awarded a penny plus costs having accused Geo Montgomery of assault and battery). After Oct 1790, George's name is not found in deeds and court records. Surviving tax lists of 1797, 1798, 1799, 1806, and 1807 do not include George's name, nor is it found in Mecklenburg Co, NC, on 1800 and 1810 censuses.

Twelve years later, at the Feb and May 1813 court sessions, George Montgomery proved two of the 17 March 1785 deeds he had witnessed for Peter Johnston to Francis Hodge. Where was he between those dates?

That is the last mention found so far of these Montgomerys in Mecklenburg Co, NC records. That is absolutely all I have, so I cannot tell you more. If anyone recognizes this family or has more details, please let us know.
