THIS DATA WAS RESEARCHED BY A FAMILY MEMBER WHO HAS BEEN DOING THIS GENEALOGY PROJECT FOR MANY YEARS. HE WENT TO THE DIFFERENT STATES AND COUNTY OFFICES DURING HIS BREAKS FROM TEACHING, TO GATHER THIS AND MUCH MORE DATA. As stated, more data is avail, but I figure if this amount can’t draw out some skeletons, then more would just compound matters. Please note #3 of this report. Joseph Nelson Messer. He could be the link to England and beyond. I say this because I am stuck at this point and would like to carry on. While I was in my local State Genealogy Library the other day, I started thumbing through the books on the shelf listed as, “SURNAMES” and their origin. Below is what I found in several different volumes for the name “MESSER”. I make no apologies for spelling in any part of this text as a whole. All five names in the group refer to the officials who measured off the land allotted to each peasant and in general supervised its use, at least trying to keep destructive animals off it. He testified for Elizabeth Gregory Messer in a court case against Stephen Messer and Francis Laws on 10 Jan 1833. Sion enlisted in the War of 1812 on 9/1/1812 and listed as having deserted 9/22/1812, but in those days when battles were over or crops needed planting or harvesting, the men would just go home, and plenty did just that. There is a statement in Sion's war record that states his brother gave a statement that he Tilford Messer drove a government wagon train in 1864 in Knoxville, Ten. This is in the general Affidavit "Tilford Messer, age 45 years states that he is the brother of the applicant and has been acquainted with him all his life. Has known the applicant since his discharge from the service intimately he having worked together driving government teams at or near Knoxville, Tennessee which was in the year 1864. Carnes and Matilda his wife, late Matilda Gregory, Peggy Gregory and Austin Webb and Joannah his wife, late Joannah Gregory and John Patton and Jeriah Gregory be made defendants to this bill and compel to answer the same, that your Commonwealth Writ of Subpoena be granted upon final hearing the will be set aside and held for naught and complainants decreed their legal proportions of the estate of the deceased said such other and further relief as may ______ with the rules of chancery practice as in duty bound they will ever pray. An amendment to the original bill of Sion Messer and Polly his wife in the Knox County Circuit The complainants state that since filing their original bill in this cause they have ascertained to a certainly as they believe, that the said Thomas Gregory died in Roan County Tennessee, and not in Monroe County when the pretended will seems to have been proven, and that decedent was dead before the writing of the pretended will was finished. They further charge that the said will never has been proven and recorded in the County court of Knox, where it should have been proven and recorded. They further charge that for several days previous to the death of decedent, he was Holy incapable to dispose of his property by will owning to the situation of his mind, they further charge that the said Executers wanted the estate and thought the estate in debt and sold real estate when it was necessary, that they created charges against the estate for services which were exorbitant and ____ which aught not to have been allowed, even if they had been Exrs lawfully appointed. That they believe that their portion of the land unlawfully sold and disposed of by the Exrs is worth at least $400. They have further discovered that a certain John Pattent (Patton) is the owner of said land by some kind of purchase from the Exrs. and some of the heirs--- They therefore pray that the said Pattent may be made Defendant and be compelled to answer this and his original bill and show much of said land he claims and how he denies bills to the same, and that upon a final hearing the said will and all proceedings and sales under the same may be set aside and held for naught, and that complainant be decreed their just proportions of the said estate and pray for general relief.
