Will: Jedediah Varney (1869)

Know all men by these [words?] that I Jedediah Varney of Gray in the County of Cumberland and State of Maine, being weak in body but of a sound and perfect mind and memory, blessed be Almighty God for the same, do make publish and declare this my last will and testament in [?] and fair following, viz
First I give and devise unto my eldest son William Varney of Anoka in the County of Anoka and State of Minnesota a certain lot of land selected in Anoka in the County of Anoka State of Minnesota being the North West corner of Section numbered ten in said Anoka containing eighty acres more or less, and being the same lot formerly owned and occupied by my youngest son Samuel I. Varney late of said Anoka deceased, to have and to hold the same to him the said William Varney and his heirs and assignees forever.
Second I give devise and bequeth unto my eldest daughter Mary Jane Legrow wife of William Legrow of Gray in the County of Cumberland State of Maine her heirs and assignees forever, all the last residue and remainder of my estate and freehold and mixed wherever found and however situated, including all pension money as well as all other dues, demands and claims.
Third My sons John M. Varney deceased Jedediah Varney and Jim Varney of Lowell County of Penobscot, Isaac Varney and Joseph Varney of the State of Minnesota, Stephen of Illinois and my daughter Lydia Hartauk of Anoka Minnesota, having received what I consider their distributed share of my estate, nothing is given them or their heirs in this will.
Lastly, I do hereby appoint my son-in-law William Legrow of Gray in the County of Cumberland and State of Maine sole executor of this my last will and testament herby revoking all former wills by me.
In witness where of, I have hereunto set my hand and seal this twenty second day of February in the year of our Lord one thousand eight hundred and sixty nine.

Signed sealed published and declared by the said Jedediah Varney to be his last will and testament in presence of us who at his request and in his presence and in the presence of each other have subscribed our names as witnesses thereto.

Dear Sir
In regard to the will of Jedediah Varney would say- I do not wish to be appointed executor but wish to have the will probated and have certified copies of will and probate to send to Minnesota to perfect the letter of that land in the legatees.
There is no estate in the State to necessetate the appointment of an executor here.
