Update:
I have been told that a George Rolla HIGHSMITH (1846-1909) married an married to Emma Florence McKINNEY(1858-1955). She was the daughter of Jonathon McKINNEY and Elizabeth HENSLEY.
The 1870 Carroll Co. MO census shows at 328/327:
MCKINNEY Jonathan 49 m w farmer $16,500 $1395 b. AL
Elizabeth 42 f w b. KY
Geo W 31 m w b. MO farming
Thomas E. 18 m w b. MO
Mary E. 16 f w b. MO
Emma F. 12 f w b. MO
Clifton D. 8 m w b. MO
William 4 m w b. MO
GREEN Montien? 18 m b farm laborer $90 b. MO
This George W. would either be a brother or a son of Jonathan and a wife before Elizabeth. The census shows Emma who married HIGHSMITH (one of the people called as a witness). And a Thomas MCKINNEY (a Thomas MCKINNEY was called as a witness). So I imagine that this G. W. MCKINNEY would be the one on trial, and not mine.
