“Will of Joseph McKee
In the name of God Amen:
I Joseph McKee. being of sound mind and memory, but under bodily affliction, do make this my last will and testament hereby revoking all former wills which I have heretofore made,
And as it regards what wordly property it has pleased a kind providence to blefs me with, I make the following distribution, viz.
Clause 1st. sec. 1st,, I will and wish that all my property both real and personal be sold, at a suitable time, by my Executor; (hereby intending to include the land now in dispute between myself and Eleanor Philips if the suit should be determined in my favour of hereafter ^determined^ in favour of my Executor)
Clause 2nd Sec 1st,, I will that, out of the proceeds of the sale of my property mentioned in clause first of this my will, all my just debts be paid, and that ^the^ remaining part of the proceeds of said Sale together with all my choses in action (hereby ^meaning^ my notes both promissory and sealed, and accounts, be subject to the following distribution, Viz:
sec. 2nd,, I will to my brother William McKee fifty dollars, and to my brother James McKee fifty dollars:
Sec 3rd I will, that after the provisions made in the first and second sections of this clause, be fulfilled, the remaining part of the proceeds of the sale of my property (as authorized in Section first of the first Clause to be made by my Executor) be divided into to two equal portions; one portion & will to be given to my Sister Elizabeth McKee, and the other portion to be given to my brother Samuel McKee.
sec 4th I will that all my choses in action as described in the first section of this clause be divided between my sister Elizabeth McKee and Samuel McKee in equal portions.
Clause 3rd sec. 1st If I have not included all my Estate in the foregoing part of this my will, I will that whatever may not be included, whether landed or personal property, it be sold and the proceeds divided between my Sister Elizabeth McKee and Samuel McKee….” [End of Page One] [Start of Page Two] “…Will of Joseph McKee. I do hereby constitute and appoint my brother Samuel McKee my Executor, to cary into effect the provisions of this my last will and testament this nineteenth April A.D. 1843 signed & sealed in the presence of us as subscribing witnefses who have signed it at the testators’ request, and who have signed it in the presence of the testator and the presence of each other with the words “Determined” and “meaning” interlined.”
