Because there is a lot of misinformation about this couple posted on the internet, I hope I can help researchers with some accurate information about them. John McCallister was born about 1775 in Virginia. He died between the 1820 and 1830 censuses (probably about 1825/1826) in Bath/Alleghany Co., Virginia. He was the son of Thomas McCallister who left an Alleghany Co. will written 18 May 1827, probated May Term 1829. (Allegheny County Will Book I , pages 184-185) John was not mentioned in Thomas' will, but he was listed as a son in an 1831 court fight over Thomas' estate. (Allegheny Co Deeds Book 2, pages 200, 202, and 208.) Thomas gave John a piece of land prior to his death. Apparently, Thomas did not execute the proper documents to transfer the land. As a result, John's brother William claimed John's land as his own inheritance under Thomas' will and sold the land. In 1831, James Davis brought an action on behalf of John's children, Thomas, William, Andrew, Samuel, Archibald, Polly, John, Alexander, and James M. to have the sale set aside. This was done. In the court documents, John was listed as the son of Thomas. (Allegheny Co Deeds Book 2, pages 200, 202, and 208, abstracted in "Abstracts of Alleghany County, Virginia, Deeds 1829-1833," Marsha Martin, Heritage Books (1997).) Some of the children mentioned in the estate fight, Thomas, William, Andrew, Samuel, Archibald, and Polly, were John's children with Mary Kincaid and were listed as her children in a November 16, 1833, Franklin Co., Missouri, deed transferring land owned by the estate of Mary's brother James Kincaid. The other children were the children of John and his second wife. She probably was named "Barbara" because there was a Barbara McCallister on the 1830 census in Allegheny Co. living near John's widowed mother Jane, his brother William, and his oldest son Thomas. The older John McCallister married Mary Ann Logue. They were on the 1810 and 1820 censuses in Monroe Co., Virginia, not Bath Co., Virginia. Mary Ann Logue McCallister survived her husband by more than a decade and wrote a will on December 12, 1835 in Greenbrier Co., Virginia. The will was probated in the May term of 1838 (Greenbrier County, Virginia, Book 2. p. 78). Janice Notify Administrator about this message?
