In Reply to: John Radford m. Elizabeth and/or Agnes Maxey? by Kent McMahan of 1491

I'm told by someone who has read Hester Garrett's supplement #3 to her "A Book Of Garrotts", states Garrett mentions only that John Radford had a daughter named Agnes. No unreasonable, but hardly proof.

Edythe Maxey Clark's 1980 edition #1, the only one I have access to, states that Elizabeth Maxey "had probably just married John Radford at about the time he patented a 400-acre tract in Henrico Co., VA., on 17 August 1725, next to the lands of her father and brother (Ref. Virginia Land Patents, Bk. 12, p. 240)."

Clark also says that her mother, Susannah Maxey, mentions her daughter, Elizabeth Radford, in her 31 May 1743 will (Ref. Goochland Co., VA., Deeds & Wills, Bk. 4, pp. 212-13). So it clear that Elizabeth married John Radford. Clark supports this marriage by a 25 February 1750/51 Cumberland Co. land sale by John and Elizabeth Radford.

I think I have also found evidence in Edythe Maxey Clark's 1980 edition which indicates John Radford's 1st wife had died before he married Elizabeth Maxey. Clark states on page 80 as follows:

"John also patented 175 acres in Amelia Co., VA, on the south side of the Appomattox River and straddling Sandy's Creek, on 20 August 1734. He added to that tract and on 9 July 1737 the entire amount was repatented (Ref. Virginia Land Patents, Bk. 15, p. 275; Bk. 17, page 380). On 18 March 1740 he sold 160 acres of this land to his former brother-in-law William Barnes, and on 17 June of that year William and Elizabeth Barnes of Amelia County sold to John Radford 300 acres in Goochland Co., part of an original patent granted to William on 28 September 1730 (Ref. Amelia Co., VA., Deeds, Bk. 1, p. 466; Goochland Co., VA., Deeds, Bk. 3, p. 312)."

The evidence that persuades me is the 18 March 1740 land sale from John Radford, which does not mention his wife or release of her dower rights. Based on info at the following web page,:

http://home.nc.rr.com/rwbaird/Misc/Legal.htm

I have concluded that John Radford's 1st wife had died before the sale. If, living, she should have had to relinquish her dower rights since the land was apparently patented during their marriage. I suspect this may have been part of the basis for others to conclude that he married twice.

Of course, evidence as to the name of his 1st wife remains to be found. Based my source's reading of Hester Garrett's supplement #3, she gives no evidence for her being an Agnes Maxey. Based on Garrett's imadequate documentation of her conclusions, I'm not surprised she missed the evidence in Clark's book that John Radford married Elizabeth Maxey. But, I am surprised that Clark missed the implication of the above 1740 Amelia Co. land sale. She appears to be a renowned Maxey genealogist.

On the basis of the above excerpt, I'm guessing that John Radford and wife #1 lived in Amelia Co. until her death ABT 1738. I'm waiting to hear from a source as to why he has her death on 18 March 1737/38, but I'm guessing it has to do with the 18 Mar 1740 land sale. I have another usually reliable source (who never responds to e-mail queries!) that has John Radford's wife, Agnes Maxey, as dying 18 Mar 1739/1740, which is a match with the land sale date. My communicating source, whose computer is toast, also has her married to John Radford 1 Nov 1719 in Henrico Co., VA. I also expect him to give me his basis for that date.

So, after seeing what Edythe Maxey Clark and Hester Garrett had to say, I'm currently persuaded that John Radford married twice to 1st Agnes??? Maxey, who had most of his children, and 2nd to Elizabeth Maxey. Leon Pitman's AFN:HVC has this Agnes as the daughter of Edward and Susannah Maxey. Based on John Radford's 400 acre Henrico Co. land patent, I'd guess Pitman was probably right.

I'd like to hear some rebuttal evidence or, lacking that, arguments.
