County of Davis
On the 7th day of May AD 1864, personally appeared before me William Cameron, Clerk of the District Court of the said County of Davis in the State of Iowa, Joseph Robb, a resident of Marion township in the said county of Davis and State of Iowa aged thirty five years, who being first duely sworn according to law, dothe on oath make the following declaration as guardian of the minor children of Wesley Matherly, deceased, in order to obtain the benefits of the provision made by the act of Congress approved July 14, 1862, granting pensions to minor children, under sixteen years of age of deceased officers and soldiers that he is guardian of James Matherly, Rachel Matherly, William J. Matherly, Elizabeth Matherly and Armilda Matherly, whose father (the said Wesley Matherly) was a private in Company E, commandered by Captain Joung? the Third Regiment of Missouri Volunteer Cavalry in the war of 1861, and that the said Wesley Matherly died at Jacksonport in the State of Arkansas on the 16th day of December (AD 1863) in the year 1863, ____ _____ his said death was caused by chronic Diarrhea; that the mother of the children aforesaid died on the 16 day of February in the year 1862, and that the dates of birth of his said wards are as follows, the said James Matherly was born on the 12th day of March in the year 1848, the said Rachel Matherly was born on the 12th day of January in the year 1850, the said William J. Matherly was born on the first day of November in the year 1853, the said Elizabeth Matherly was born on the 27th day of January in the year 1857, and the said Armilda Matherly was born on the 9th day of March in the year 1860. He further declares that the parents of his said wards were married in the county of Estill in the State of Kentucky on the first day of August in the year 1838 and that the annexed marriage certificate relates to their marriage, that the only children which the said Wesley Matherly left surviving him under the age of sixteen years. He is also well acquainted all the time since their births that no family record nor other record has been kept nor made of the times of the births of said children. "
Note that Joseph Robb b. 13 Nov 1828, Bartholemew Co, IN, m. 28 Sep 1850, Drusilla Lowe, b. abt 1832, KY. Joseph died 13 Nov 1891. Drucilla Lowe was sister of Nancy Lowe Matherly (the mother of the above children).
