Hittabold Smith was living in Tyendinaga Twp Hastings County , not Thurlow Twp in 1840 when she did her Upper Canada Land Petition . She was originallymarried and then that was stroked out to a widow status before the completion of her Petition in 1840. As per 2 Feb 1835 Land Record held in Belleville Land Records Office, Nora Kearney of Belleville copied out the land transaction between James Martin and Philip Hotts where James Martin was the grantor and his wife was listed as Mahetable Martin who gave up her dower to this piece of property. The witnesses were Malcolm McPherson and his wife Margarett of Thurlow Twp. Malcolm McPherson was a millwright. It appears that the finalization of this land was not completed until 5 Oct 184o with the witnesses being C-- Ketcheson Jr Esq and Anthony Marshall two of his majesty's Juntice of the Peace for the Midland District ( Hastings County ). There James Martin of Conc 5 Lot 8 of Thurlow Twp was married to a much younger woman Hittabold Smith, daughter of Richard Smith and Betsy Lake.
