DNA has now proven this to be NOT true!
>>>I'm descended from BARBARA SMATHERS (1763) & ZACHARIUS LYERLY (born 1760), eldest son of Rowan County, North carolina, planter JOHN CHRISTOPHER LYERLY<<<<
http://www.members.dca.net/smothers/dnahttp://www.members.dca.net/smothers/dna
Francesa is from a John Smathers but can NOT be this John LYERLY Smathers.
a DNA participant from the John Smathers-Mary Agner line has matched up exact on 12 markers to 5 known men [Smathers, Smethers, Smithers & Smothers] that all paper trail back to John Smathers family of Wm Smither d 1760 Berks co Pa.
So the question now is.....WHO and WHAT was the name of this Lyerly son born from Zacharius and Barbara Smither.
Dont believe they were married but more like a common law marriage type situation. Was his name John?Did Wm Smither 2, son of Wm Smither 1 really adopt him and call him John Smathers? this has totally confused the family on this situation and trying to clear it up. If anyone has any more recent data, PLEASe get ahold of me personally.
this is some of the data I have found. Col Smathers has since died and all his data that once was in the Smither Archives in Silver Springs MD are in possession of a cuz that has no email.

Rowan County: 6 Nov 1782 4:326 specie paid to GH Berger by Malt Troy, esq. 25/c for fine for bastardy Zachary Lyerly on the body of Barbara Smither and delinquents have compromised.
[does this mean Zachary & Barbara were minors?]

This child of Barbara Smathers and Zacharias Lyerly was called John Smathers.John remained with his mother Barbara and was reared in the home of his grandparents William Smither II and wife. John, obviously, maintained the last name Smathers rather than Lyerly.
Maria & William's daughter BARBARA (b 1764) entered into a secret common-law marriage with Zacharius LYERLY in 1780. He didn't want to be disinherited by his disapproving father, whom he thought was dying. Lyerly pere survived, Lyerly Jr disavowed the marriage, and was taken to court to pay a 'bastardy bond' for his son JOHN who was legally adopted by his grandfather William Smither II.

The "Bastardy Bonds" of North Carolina contains bonds posted because of the birth or impending birth of a bastard child. These bonds were intended to protect the county or parish from the expense of raising the child. When the pregnancy of a woman or birth of a child was brought to the attention of the court, a warrant was issued and the woman brought into Court. She was examined under oath and asked to declare the name of the child's father. The 'reputed' father was then served a warrant and required to post bond. If the woman refused to name, the father, she, her father or some other interested party would post the bond. In some cases, the mother and reputed father together posted the bond. If the woman refused to post bond or declare the father, she was often sent to jail. The records are indexed by county and complimented by a full-name index at the back of book for easy references. The following North Carolina counties are included in this hefty publciation:
Alamance, Alexander, Alleghany, Anson, Ashe, Bertie, Brunswick, Buncomb, Burke, Bute, Cabarrus, Caldwell, Camden, Carteret, Caswell, Catawba, Chatham, Cherokee, Chowan, Clay, Cleveland, Craven, Cumberland, Granville, Moore, New Hanover, Rowan, Rutherford, Surry, and Wake.

The "Bastardy Bonds" of North Carolina contains bonds posted because of the birth or **impending birth of a bastard child.**
Pending birth ?? - which would mean that in August 1782 (if this is the first bond) the child wasn't born yet -
Now if this is the case, this son then was not born until abt 1782 and not in 1781 which is the dob for John Smathers md Mary Agner that most folks until recent DNA results, have thought belonged to the Lyerly boy.

Analysing the above
BASTARDY - Persons. The state or condition of a bastard
The term 'bastardy' is used in the original records of the Archdeaconry, the modern term illegitimacy.
Illegitimacy-the quality or state of being illegitimate
2 : BASTARDY -
1 : the quality or state of being a bastard : ILLEGITIMACY
2 : the begetting of an illegitimate child
