Will of James Seeley Losey Apr. 8, 1795 - May 13, 1851
WILL OF JAMES LOCEY deceased (transcribed so there may be errors)
In the name of the benevolent father of all.
I, James Locey of Tuscarawas County & State of Ohio do make and publish this my last will and testament.
1st. My will is that the expences of my last sickness and funeral be paid.
2nd. Also all just debts by me owing at the time of my death.
3rd. After my wifes thirds are taken out according to law I give and devise the balance of my property bothe real and personal to be divided equally share and share alike among my children. Namely, John Locey, Samuel Locey, Sela Locey, James Locey, Perry Losey, Catherin Holbit, Samantha Locey and Ezra Locey-with the following exceptions that is I give and devise to my dear and beloved wife one two year old roan colt. To my son John I give and devise my large family bible. To Samuel I give and devise my wearing apparal- to my son James I wish him to keep for his own use one 3 year old colt a bay and one 2 year old roan colt with a bald face and one yoke of 2 year old steers now claimed by him, and it is my will that my son Ezra Locey shall have fifty dollars extra above his common share with the balance of my children--also to haveexpences of his board and rainment of the farm untill he arrives at the age of 16 years also to have the expences of a common education.
I do hereby nominate and appoint Jeremiah D. Conwell guardian of my son Ezra Locey untill he shall arrive at the age of twenty one years. It is my will that the farm on which I now live shall not be sold during the lifetime of my present wife unless it can be done with the consent of all parties concerned. Lastly I do hereby constitute and appoint Lewis Conwell of the County and State aforesaid to be the Executer of this my last will and testament.-it my will that James shall have my rifle gun.
In testamony whereof I have hereunto set my hand and seal this 4th day of April in the year of our Lord 1851.

At a Special Court of Commnon Pleas held at the Court House in New Philadelphia within and for the County of Tuscarawas and State of Ohio, on the 31st day of May in the year of our Lord one thousand eight hundred & fifty one, were present James Patrick, Morris Creter and Jacob Blickenaderfer, Judges of said Court. In the record and proceedings of said Court then and there had and held are the following
The Last Will & Testament of James Locey deceased was this day brought into Court and the witnesses thereto, to wit, J.D.Conwell and Lewis Conwell came before the Court and being duly sworn say that the deceased signed and subscribed said will at the end therof in the presence of said witnesses, that they said witnesesses attested and subscribed said will as witnesses in the presence of said deceased. That the Testator at the time of executing said will was of full age, of sound mind and memory and not under any restraint, which testimony is hereby reduced to writing and filed and the Court being satisfied that said will has been duly executed attested and proven as aforesaid the same is admitted to probate. Whereupon it is ordered that letters testamentary with the will annexed issue to Lewis Conwell the Executer named therein, that he give bond in the sum of six hundred dollars with Esra Brainard and Jacob Hawk as sureties who are approved as such. Pretyman Conwell, Jacob Bayer nd Abraham VanVoral are appointed appraisers of goods. And therupon came into Court Eliza Locey widow of said James Locey and elects to take unde said will inlieu of dower.
