Another issue to consider is that Texas SB 1243 appears to be on its way to passage. It will require registration with the state, background check, finger printing, $2 million surety bond, and other requirements for people who:

<<(8-a)AA"Heir finder" means a person who for payment of a
fee, assignment of a portion of any interest in a decedent’s estate, or other consideration provides information, assistance, forensic genealogy research, or other efforts related to another person’s right to or interest in a decedent’s estate.>>

If this law is passed, any genealogist basing their fee on a person’s right to or interest in a decedent’s estate will have to be a registered heir finder with the Texas Private Security Board.
